Mounds View Charter – Chapter 4 <br /> <br /> <br />Section 4.01. - The regular municipal election. <br />A regular municipal election shall be held on the first Tuesday after the first Monday in November of each even-numbered year at such place or places as the city council may designate. <br /> The city administrator shall give the appropriate notice of the time and place of holding such election and of the officers to be elected as required by Minnesota law, but irregularities <br /> in giving such notice shall not invalidate the election. <br /> <br />Section 4.02. - Special election. <br />The council may by resolution order a special election and provide all means for holding it. The administrator shall give the appropriate notice of a special election as required by <br /> Minnesota law. The procedure at such election shall conform as nearly as possible to that prescribed for other City elections. <br /> <br />Section 4.03. - Filing for office. <br />Any voter of the City qualified under the State Constitution for elective office may, by filing an affidavit and paying a proper filing fee to have their name placed on the municipal <br /> primary election ballot or, if there is no primary election, on the municipal election ballot, with all such actions being consistent with all procedural requirements as required by <br /> Minnesota law. <br /> <br />Section 4.04. - Procedure at elections. <br />Subject to this charter and applicable Minnesota law, the council may by ordinance further regulate the conduct of municipal elections. Except as otherwise provided by this charter <br /> and supplementary ordinances adopted consistent with Minnesota law, general Minnesota law on elections shall apply to municipal elections. <br /> <br /> Section 4.05. – Vacancies <br />Any vacancy in an office shall be filled by council appointment until an election is held as provided in this section. In each case, the City Council shall by resolution declare such <br /> vacancy to exist and shall appoint an eligible person to fill the vacant office until the next regular City election is held. In the case of a tie vote in the City Council for a vacancy <br /> in the position of a City Council member, the Mayor shall make the appointment. In the case of a tie vote in the City Council for a vacancy in the position of Mayor, the Acting Mayor <br /> shall make the appointment. If the vacancy occurs before the first day to file affidavits of candidacy for the next regular City election and more than eighteen (18) months remain <br /> in the unexpired term, a special election shall be held at or before the next regular City election and the appointed person shall serve until the qualification of a successor elected <br /> at a special election to fill the unexpired portion of the term. If the vacancy occurs on or after the first day to file affidavits of candidacy for the regular City election or when <br /> less than eighteen (18) months remain in the unexpired term, there need not be a special election to fill the vacancy and the appointed person shall serve until the qualification of <br /> a successor.
