In your communications, you :, Z h indicate that you have <br />been asked to re ign by the Mounds View City Council. You each seek 4ddance as to the authority <br />of the City Council over the Charter Commission and the proper proced-ule for removing a member <br />of the Mounds '- ew Charter Commission. <br />As a judge w1710 may be called upon to render rulings related to the Mounds View Charter <br />Commission, I ::annot comment on the substantive rights and obligslions of you or any other <br />interested part1es. At most, I can cite the governing statute, Minnesota Statutes, section 410.05, to <br />enable review by you, your legal counsel, or counsel for the Mounds View Charter Commission. <br />Subdivision 2 � �f the statute authorizes the Chief Judge of the District Court in which a city is <br />situated to fill Charter Commission vacancies by appointment. At present. I have not received any <br />formal notification of an opening on the Mounds View Charter Commission. However, a <br />document attached to one of the emails appeared to be a letter of resignation from Commissioner <br />Marisa Reyes-.-;,--'nison. Has Ms. Reyes -Johnson in fact resigned? If S-0 I will start the process to <br />fill the open seat. Our process usually begins by issuance of a press release to advertise for <br />applicants with ca! fixed deadline. Therefore, it is important to advise Ra=-1_sey County District Court <br />administration lvthenever there is a vacancy. Subdivision 3 of the statute also states that "[a] city <br />council, a charter commission, or the petitioners requesting the appointment of a charter <br />commission may- submit to the court the names of eligible nominees which the district court may <br />consider in .malting appointments to the charter commission." No names for a possible current <br />opening have been submitted from any source. Either way, if there is an opening, please advise <br />immediately. <br />Subdivision 2 of the statute also sets forth the procedure for removs-ig a charter commission <br />member.
