Within 10 calendar days of receipt of the petition, the Clerk-Administrator shall examine the <br /> pet determine if its sufficiency and report to the within to days-- <br /> the City Council. Upon receipt of the <br /> report, the Council shall determine immediately declare the sufficiency of the petition by <br /> resolution the stiffieieney including the reported date of determination of <br /> sufficiency. <br /> Section 5.04. Disposition of Insufficient or Irregular Petition. If the cetineil Clerk- <br /> Administrator determines that the sufficiency of a petition iscannot be declared, it shall <br /> be determined to be insufficient or irregular. The Clerk-Administrator shall deliver a <br /> copy of the petition, together with a written statement of its defects, to the sponsoring <br /> committee and to the City Council within 10 calendar days. The committee shall have <br /> thirtyZ1 calendar days in which to file additional signature papers and/or to correct the <br /> petition in all other partiettlars,exeept that,in the case of a petition for r-eeall,the eommittee may not ehange the <br /> statement of the grounds on whieh the roes„ i h+.specified irreaularity. Within five9 calendar <br /> days of receipt of the corrected petition, the Clerk-Administrator shall again repot t, , <br /> „ne:,. if the Couneil finds that the pets determine if sufficiency of the petition as corrected <br /> can be declared by the City Council and proceed as directed in Section 5.03. If the <br /> etition is still insufficient or irregular, the City Council shall pass a resolution of <br /> Insufficiency and this shall be considered the Final Finding. The Clerk-Administrator <br /> shall file the petition as noted and notify the sponsoring committee within 10 calendar <br /> days that no further action will be taken. The final finding that the petition is insufficient <br /> or irregular shall not prejudice the filing of a new petition for the same purpose <br /> unless otherwise specified within this Charter. Except in the case of a petition for recall, <br /> it shall snot prevent the Council from referring the subject matter of the petition to the <br /> voters at the next regular or special election. <br /> Section 5.05. Initiative. Any ordinance may be proposed by a-petition. <br /> state at the head of eaeh page or attach d - he exaet text of the proposed ordinanee. if the Goaneil passes <br /> proposed ordinanee with ameadments,and a majority of the sponsoring eorimnittee do not disapprove the arnead <br /> form by a statement filed with the Clerk Administrator within ten days of its passage by the Couneil,the efdinanee <br /> need not be submitted to the voters. if the Couneil fails to enaet the efdinanee in a fem aeeeptable to the majority <br /> of the sponsoring eennnittee within si*4y days after the final determination of suffieieney of the petition-, aw <br /> rdina ee as originally proposed s The exact text of the proposed ordinance must be stated <br /> at the head of each page of the petition or attached thereto. The petition once filed with <br /> the Clerk-Administrator shall be valid for 180 days during which time a completed <br /> petition with signatures must be filed. Within 60 calendar days after final determination <br /> of the petition's sufficiency under the provisions of Section 5.03 of this charter. the <br /> Council may either hold a first reading of the ordinance, as defined in Section 3.05 of <br /> this charter and proceed with the adoption process, or propose an amendment to the <br /> petitioned ordinance. If an amendment is proposed by a maiority vote of the Council <br /> and presented to the petition committee, the petition committee has 14 calendar days <br /> from the receipt of the amended proposed ordinance to disapprove the amendment by <br /> maiority vote, and file a statement with the Clerk-Administrator.
