The center cover plate was missing, and
as a result the center iron pivot post , which came in contact with
the top of the side shield plate whenever the merry-go-round
happened to tilt was exposed . The boy placed his right index
finger in the open area and as the merry-go-round tilted , the
finger was badly mangled . At the hospital the finger was amputated .
8 . Brady v. Kenosha 169 Wis 379 , 172 NW 711 ( 1919) .
An intake pipe raching several hundred feet into Lake Michigan had
been laid across the bathing beach . Next to the shore for a dis-
tance of 25-30 feet, the trench had been filled in and it appeared
that by action of the waves, it was also closed for a distance
into the lake . However about 100-125 feet out, the trench had
not been filled in and there was a hole 12-15 feet deep. At the
point where the trench began) the water was 3-4 feet deep. Death
of a twenty-three year old man was alleged to have been caused
by the unguarded hole in relatively shallow water inasmuch as he
could not swim.
10. Griffin v Salt Lake City 114 Utah 94 176 P (2d) 156 ( 1947) .
On a very warm day the guard stepped outside to get another guard
to relieve him . In the brief interval a girl and two boys worked
their way up from the shallow end to the deep end along the hand-
rail . The girl said to her companions "Let ' s see how deep it is . "
She released her hold on the handrail (none could swim) and when
she came up she was near the diving board. She went under twice
more and did not come up the last time, just as the relief guard
appeared . By the time the guard reached her it was too late .
11 . Doran v. Kansas City, 237 SW (2d) 907 ( 1951) .
A creek flowed through a park. Children customarily played in the
creek bed which was smooth except at one end where there was a
deep hole caused by heavy rains . The creek bed was unguarded
and unposted. The bicycles of two boys slipped into the water at
the end with the hole . The younger, 7 years old, tried to get
the bike and his older brother, nine, then attempted to help him.
Both drowned.
12 .
