ORDINANCE NO. 391 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW <br /> BY AMENDING CHAPTER 52 ENTITLED, "PARKS , PLAYGROUNDS , OPEN <br /> SPACE AND RECREATION AREA RULES AND REGULATIONS" , <br /> SUBCHAPTER 52. 03 INTOXICATING AND NON-INTOXICATING LIQUOR <br /> The Council of the City of Mounds View does hereby ordain: <br /> SECTION I . Chapter 52. 03 , INTOXICATING AND NON-INTOXI- <br /> CATING BEVERAGES is amended to read as follows , <br /> CONSUMPTION OF INTOXICATING AND NON-INTOXICATING <br /> BEVERAGES . No intoxicating or non-intoxicating bev- <br /> erages shall be consumed , displayed , or possessed in <br /> any park , playground, open space , or recreation area <br /> in the City with the exception of Silver View and <br /> City Hall Parks. Malt beverages containing not more <br /> than 3 .2 percent of alcohol by weight may be con- <br /> sumed in Silver View and City Hall Parks between the <br /> hours of 8 :00 a.m. and 9 :00 p.m. No individual may <br /> have in his or her possession more than 72 ounces of <br /> • beer at any time. <br /> SECTION II . Chapter 52. 03 , SALE OF BEER BY PERMIT. <br /> Subdivision 1 . Definitions. The following terms <br /> shall have the meanings described herein ; <br /> ( 1 ) "Sale" means all means of furnishing and <br /> includes but is not limited to the furnishing <br /> for money or other consideration. <br /> ( 2 ) "Beer" means any beverage which is produced <br /> wholly or in part from the brewing of any <br /> grains or malt or malt substitute and contain- <br /> ing more than one-half of one percent alcohol <br /> by volume and not more than 3 .2 percent by <br /> weig ht. <br /> ( 3 ) "Organization" means any entity having relig- <br /> ious, veteran , charitable or non-profit activ- <br /> ities as its principal purpose and which qual- <br /> ities in all respects for the issuance of a <br /> license to sell the type of beer to be fur- <br /> nished at the activity or event for which the <br /> permit is being sought . <br /> 41/1 Subdivision 2 . Permit. Organizations shall apply <br /> for a permit to sell beer in a City park to do so. <br /> Such application shall be made using forms furnished <br /> by the City Parks and Recreation Director . <br />
