ORDINANCE NO. 391 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW BY AMENDING CHAPTER 52 ENTITLED, "PARKS , PLAYGROUNDS , OPEN SPACE AND RECREATION AREA RULES AND REGULATIONS" , SUBCHAPTER 52. 03 INTOXICATING AND NON-INTOXICATING LIQUOR The Council of the City of Mounds View does hereby ordain: SECTION I . Chapter 52. 03 , INTOXICATING AND NON-INTOXI- CATING BEVERAGES is amended to read as follows , CONSUMPTION OF INTOXICATING AND NON-INTOXICATING BEVERAGES . No intoxicating or non-intoxicating bev- erages shall be consumed , displayed , or possessed in any park , playground, open space , or recreation area in the City with the exception of Silver View and City Hall Parks. Malt beverages containing not more than 3 .2 percent of alcohol by weight may be con- sumed in Silver View and City Hall Parks between the hours of 8 :00 a.m. and 9 :00 p.m. No individual may have in his or her possession more than 72 ounces of • beer at any time. SECTION II . Chapter 52. 03 , SALE OF BEER BY PERMIT. Subdivision 1 . Definitions. The following terms shall have the meanings described herein ; ( 1 ) "Sale" means all means of furnishing and includes but is not limited to the furnishing for money or other consideration. ( 2 ) "Beer" means any beverage which is produced wholly or in part from the brewing of any grains or malt or malt substitute and contain- ing more than one-half of one percent alcohol by volume and not more than 3 .2 percent by weig ht. ( 3 ) "Organization" means any entity having relig- ious, veteran , charitable or non-profit activ- ities as its principal purpose and which qual- ities in all respects for the issuance of a license to sell the type of beer to be fur- nished at the activity or event for which the permit is being sought . 41/1 Subdivision 2 . Permit. Organizations shall apply for a permit to sell beer in a City park to do so. Such application shall be made using forms furnished by the City Parks and Recreation Director .
