Mr. <br /> Boxrud said this was due to a flat grade backyard <br /> which does not slope towards the pond. He felt <br /> that with the installation of the pathway, this <br /> problem could be addressed by means of a swale. <br /> The meeting with residents of the Silver View <br /> Park area is scheduled for 9:00 a.m. on Saturday, <br /> April 9. If it is rained out, the meeting will <br /> be held on April 16. <br /> At this point, Commissioner Duane McCarty asked <br /> to speak to the Commission. He stated that he <br /> had searched his records and had talked to former <br /> Park Director Anderson regarding Silver View <br /> Park. He said that the Silver View Park plan <br /> was accepted by the City Council and the Park and <br /> Recreation Commission. He felt that although it <br /> was not accepted by resolution, it could still be <br /> construed as being an addendum to the master <br /> plan. As Mayor of the City at that time, Mr. <br /> McCarty assured the realtor that the plan was <br /> correct. He called Bruce Anderson and he said <br /> that to the best of his recollection, he had <br /> stated that there would not be a path behind the <br /> houses in question. Mr. McCarty informed the <br /> Commission that if they were to pursue the • <br /> pathway, the residents would litigate. <br /> Director Saarion informed the Commission that she <br /> and Clerk-Administrator Pauley had talked to <br /> Attorney Meyers, in a conference call, and he stated <br /> that he did not see a problem with pursuing the <br /> pathway installation. Councilmember Wuori reported <br /> that residents have stated that they paid a premium <br /> to ensure that the path was not located in the park <br /> area in back of their homes, Actually, all owners <br /> of homes and townhomes along the lake paid a pre- <br /> mium for the purpose of the lake view. <br /> The Commissioners concurred that the pathway is <br /> park land and available to the entire community <br /> and that they did not want to set a precident of <br /> having to consult adjacent property owners <br /> everytime the City wishes to improve park <br /> property. <br /> The Commissioners firmly stated that they were in <br /> favor of the pathway being installed around the <br /> entire pond. <br />
