I <br /> did want to get word to you right away,however,that I need more information regarding the variance <br /> requests. I need a letter from you for each of the variance requests stating how you believe the criteria on the <br /> attached list are met. I have attached samples of recent letters submitted by residents in Mounds View who <br /> were asking for variances,to show you the type of letter I need. For the variance on parking ratios,you could <br /> make the argument that the City's current parking ratios should not be applied to a shopping center of this <br /> type and include ratios from other cities which you feel are more applicable. <br /> I also wanted to let you know that the City Council voted at its meeting on September 23 to begin eminent <br /> domain proceedings to obtain the easement for the pedestrian bridge. As we indicated when Chuck and I met <br /> with you and Ed,this action is more in the nature of insurance at this point. We have discussed proceeding <br /> with putting your request for variances in sign regulations and parking ratios,and your request for a <br /> conditional use permit for joint use of parking facilities before City Council at their meeting on November 25. <br /> We have also discussed that your granting of the easement cannot be linked to a City Council approval of <br /> your variance and conditional use permit requests. The schedule,however,will give you the opportunity to <br /> know the outcome on these requests before completion of the eminent domain proceedings, and may offer <br /> another way to come to an agreement on granting of the easement. The City needs to obtain the easement by <br /> December 15 to maintain our schedule on the pedestrian bridge. <br /> I will be in touch at the beginning of the week.
