Stat. § 331A.01, <br />subd. 10. <br />Every ordinance must be published once in the city's official newspaper. <br />To qualify as an official newspaper, the newspaper must be a legal <br />newspaper under state statute, and the council must have designated it as <br />the city's official newspaper. Cities usually publish ordinances separately. <br />If the city publishes them in full as part of the minutes, the publication <br />meets all statutory requirements. <br />An ordinance must be published within 45 days after being passed. Failure <br />to publish within 45 days, however, will not necessarily invalidate the <br />ordinance. <br />A statutory city council may publish a summary of a lengthy ordinance. <br />Publishing the title and summary shall be deemed to fulfill all legal <br />publication requirements as completely as if the entire ordinance had been <br />published. To do this, the city council must do the following: <br />• The council must determine that publication of the title and a summary <br />of the ordinance would clearly inform the public of the intent and effect <br />of the ordinance. <br />• The council must approve summary publication by a four -fifths vote of <br />its members. <br />• The title and summary must conform to Minn. Stat. § 33IA. 01, subd. <br />10. <br />• The summary must include notice that a printed copy of the ordinance <br />is available for inspection by any person during regular office hours at <br />the office of the city clerk and at any other location designated by the <br />council or by standard or electronic mail. <br />• The council must approve the text of the summary prior to its <br />publication and determine that it clearly informs the public of the intent <br />and effect of the ordinance. <br />• A copy of the entire text of the ordinance must be posted in the <br />community library or, if no library exists, in any other public location <br />designated by the council. <br />• The text of the summary must be published in a font type no smaller <br />than brevier or eight -point type. <br />• Proof of the publication must be attached to and filed with the <br />ordinance. <br />It is advisable to use summary -publication authority in cases where the <br />public interest in doing so is clear, as in the case of a lengthy and complex <br />zoning ordinance where the length of the actual ordinance obscures its <br />content, and where maps and descriptions of procedures can clarify the <br />meaning. <br />League of Minnesota Cities Handbook for Minnesota Cities 8/30/2022 <br />Meetings, Motions, Resolutions, and Ordinances Chapter 7 1 Page 47 <br />
