Item No: 08D <br />Meeting Date: Aug 14, 2023 <br />MOLNDtSIEWType of Business CB <br />City Administrator Review <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Resolution 9790, Approving Minnesota Laws 2023, <br />Chapter 64, Article 10, Section 41, Allowing the City of <br />Mounds View to Impose a Local Sales Tax <br />Resolution 9791 Imposition of a local sales tax and <br />authorizing a special election thereon during the November <br />7, 2023 Uniform Election Date <br />Introduction: <br />Resolutions 9790 and subsequent Resolution 9791 are separate but related resolutions specific <br />to the Community Center Expansion. Resolution 9790 "approves/adopts" Minnesota Laws 2023 <br />which provided the City of Mounds View with specific legislative authority to allow voters the <br />ability to approve a local option sales tax. Resolution 9791 puts in place the process to put the <br />question before the voters at the November 7, 2023 election. <br />Discussion: <br />Council has been working on the Community Center expansion for two years. This past <br />legislative session, Council worked with local state elected officials to seek bonding money and <br />sales tax authority. The bonding request was heard in the Senate and is the Minnesota <br />Management Budget Capital Bonding process for next year. <br />Bonding money will pay no more than half of the project with the other half coming from the <br />local entity. The local option sales tax, as estimated by Ehlers, would provide the Cities <br />required portion and if approved, strengthen our bonding proposal. <br />The tax can only be used for debt payment and cannot be imposed prior to a project being <br />approved and funding allocated. The tax sunsets at the payment of bonds or 20 years, <br />whatever occurs first. <br />Council reviewed the resolutions at their August 7, 2023 workshop making minor revisions to <br />9791 which have been incorporated. <br />The deadline to adopt the resolution for inclusion on this November's ballot is August 25, 2023. <br />The August 7, 2023 workshop packet contained detailed correspondence from Kennedy and <br />Graven on the law, process, and steps necessary to move ahead.
