T�7 Item No: 8A <br />MOUNDS VIEW Meeting Date:09/11/2023 <br />Type of Business: Council Business <br />Administrator Review: <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Ordinance 1008, Amending Chapter 12 of City Charter by <br />Adding a Severability Clause <br />Introduction: <br />The Mounds View Charter Commission is recommending a minor, but important change <br />to the MV Charter, specifically a severability clause. <br />Discussion: <br />The Commission discussed the severability clause over several meetings with <br />Ordinance 1008 representing the final recommendation of the Commission. <br />Commission Attorney Joe Sathe worked with Secretary Amundsen and the Commission <br />on determining the final language. <br />The Commission recommends making this proposed amendment to the Charter by <br />ordinance, which will require all City Council members to vote in favor after the second <br />reading. <br />A severability clause is a relatively minor change but serves an important function by <br />explicitly providing that if one section of the Charter or the City's actions under a <br />Charter provision is impacted by a judicial decision, the rest of the Charter remains valid <br />and unimpacted. The Severability Clause serves to promote continuity of the City's form <br />of government and to limit confusion on the enforceability of the Charter should a <br />section of the Charter be challenged. <br />Recommendation: <br />Conduct first reading of Ordinance 1008 occurred on August 28th, recommend 2nd <br />reading and summary publication. <br />Respectfully Submitted, <br />Nyle Zikmund <br />City Administrator <br />DOCSOPEN\MU210\4\897854.v2-8/23/23 <br />
