4:7a <br /> When the owner or person in control of any plot of ground fails to destroy grasses or weeds growing <br /> thereon as provided herein, the Superintendent of Public Works of the city shall destroy or cause to be <br /> cut the grasses or weeds and any expense incurred by the city under the authority of the <br /> Superintendent of Public Works in so doing shall be a charge against the owner or other person so <br /> failing, which may be recovered on behalf of the city by recording a lien against the property for the <br /> cost of the cutting or by instituting an appropriate action at law. The cost shall be an amount as <br /> determined by the city. <br /> (Prior Code, § 606.03) <br /> § 91.023 LIEN PROCEDURE. <br /> (A) Notice of lien. <br /> (1) If weeds are cut by the city or by someone directed to cut them on behalf of the city, a notice <br /> of lien of the cost and expense thereof incurred by said city shall be recorded in the following manner: <br /> the city or the person performing the service by authority of the city, in its or a person's own name, <br /> may file notice of lien in the office of the county's Recorder of Deeds. The notice of lien shall consist of <br /> a sworn statement setting out: <br /> (a) A description of the real estate sufficient for identification thereof; <br /> (b) The amount of money representing the cost and expense incurred or payable for the <br /> service; and <br /> (c) The date or dates when said cost and expense was incurred by the city. <br /> is incurred. <br /> (2) Such statement shall be filed within 60 days after the cost and <br /> Yexpense <br /> (B) Release of lien. Upon payment of the cost and expense after notice of lien has been filed, the <br /> lien shall be released by the city or person in whose name the lien has been filed and the release shall <br /> be filed of record in the same manner as filing notice of the lien. <br /> (Prior Code, § 606.04) <br /> § 91.999 PENALTY. <br /> (A) Any person violating any provision of this chapter for which no specific penalty is prescribed <br /> shall be subject to § 10.999 of this code of ordinances. <br /> (B) (1) Anyperson in violation of anyof theprovisions in 91.001 through 91.009 of this chapter <br /> §§ 9 P <br /> shall be guilty of a misdemeanor. Each day on which the violation continues shall constitute a <br /> separate offense. <br /> (Prior Code, § 607.09) <br /> (2) Any person who abandons a vehicle on any public or private property, per § 91.006 of this <br /> chapter, without the consent of the person in control of the property, is guilty of a misdemeanor. <br /> (Prior Code, § 607.06) <br /> (C) In addition to liability for the cost of destruction of weeds by the city, the owner or person in <br /> control of any such plot of ground in the city failing to destroy the weeds thereon within the designated <br /> periods of time as provided in §§ 91.020 through 91.023 of this chapter shall, upon conviction, be <br /> subject to a fine as determined by the city. Each day on which the owner or person in control of any <br /> such plot of ground shall fail or refuse to comply with the requirements of §§ 91.020 through 91.023 of <br /> this chapter shall constitute a separate offense. <br />
