RESOLUTION NO.9827 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />DECLARING A VACANCY TO EXIST ON THE MOUNDS VIEW CITY COUNCIL, AND <br />PROVIDING NOTICE THAT THE VACANCY WILL BE FILLED AT AN UPCOMING <br />SPECIAL ELECTION <br />WHEREAS, a Special Election was held for Mayor on November 7, 2023; and <br />WHEREAS, Councilmember Zach Lindstrom ran for the office of Mayor and was elected by <br />the citizens of Mounds View; and <br />WHEREAS, under Minnesota Statutes, section 351.02 and the Mounds View City Charter <br />("City Charter"), section 2.05, Mayor Lindstrom resigned his Councilmember seat when he accepted <br />the office of Mayor, which results in the Councilmember vacancy; and <br />WHEREAS, Section 4.05 of the City Charter specifies that if more than 365 days remain in <br />the unexpired term of a vacant seat, then the City must hold a special election to elect a replacement <br />to serve for the remainder of the unexpired term, term scheduled to expire December 31, 2026; and <br />WHEREAS, according to Minnesota Statutes, Section 205.13, candidate filing will run from <br />January 30th through February 13th, 2024, with absentee voting beginning February 23d; and <br />WHEREAS, the next uniform election date on which a special election can be held is April 9, <br />2024. <br />NOW, THEREFORE, BE IT RESOLVED, the City Council hereby acknowledges that the <br />election of Councilmember Zach Lindstrom to Mayor creates a vacancy on the Mounds View City <br />Council as of November 13, 2023, in accordance with Minnesota Statutes, section 351.02 and the <br />Mounds View City Charter, section 4.05. <br />BE IT FURTHER RESOLVED, that the City Council hereby declares that the vacancy <br />created by the election of Mayor Lindstrom effective November 13, 2023, will result in more than 365 <br />days remaining in the unexpired term of the vacancy seat, and requiring that the City Council call a <br />special election to fill the vacancy seat for the remainder of the unexpired term. <br />BE IT FURTHER RESOLVED, that the City Council hereby calls a special election to be held <br />on April 9, 2024 to fill the Councilmember seat vacated by Mayor Lindstrom; and <br />BE IT FURTHER RESOLVED, that the City Administrator is here by authorized to take all <br />steps reasonably necessary to accomplish the intent of this Resolution and abide by the <br />requirements of the City Charter and Minnesota Statutes including publishing notice of the vacancy <br />and that such vacancy will be filled at a special election to be held on April 9, 2024, and working with <br />Ramsey County to administer the special election as authorized and agreed to under the Elections <br />Services Agreement between the City and County. <br />Adopted this 27th day of November, 21 <br />ATTEST: <br />0 <br />Nyle Z' mund ity Administrator <br />
