Metro Cities Staff Summary of Legislation specific to housing/zoning/parking <br />requirements/public comment <br />Missing Middle Housing bill — SF 3964 (Mitchell): <br />• Cities of the first-class must allow for the development of between four and ten <br />residential units on all residential lots, regardless of the lot size or water and sewer <br />infrastructure capacity. <br />• Cities of the second, third and fourth class must allow the development of between two <br />and eight residential units on all residential lots, regardless of the lot size or water and <br />sewer infrastructure capacity. <br />• The bill does not consider overall lack of public infrastructure capacity, but forces cities <br />to accept additional density without any consideration for how re -sizing infrastructure <br />will be paid for to support the additional density, which will ultimately be borne by <br />existing residents. <br />• Sets minimum lot size requirements which are unreasonable to support the level of <br />density mandated in the bill. <br />• Prohibits cities from requiring more than one off-street parking space per residential <br />unit, prohibits any off-street parking requirement for a dwelling unit that is less than a <br />mile from a transit stop. Limiting parking minimums while requiring higher density could <br />result in developers underbuilding parking resulting in spillover onto city streets that <br />were not designed to accommodate dense on -street parking. <br />• An expedient administrative design review process for 'middle' housing, this eliminates <br />a resident's ability to voice concerns over material impacts a project would have on <br />their property, taking away local community input. <br />• Limitations on aesthetic mandates. <br />• Accessory Dwelling Units (ADUs) are authorized by right. <br />Multifamily Housing bill — SF 3980 (Pha): <br />• Requires all cities to permit by right a multifamily building up to 150 feet in commercial <br />and residential areas. This does not allow for the ability to ensure reasonable setbacks <br />for fire and safety. <br />• Requires approval if multifamily development is consistent with a city's comprehensive <br />plan, this ignores the long-range planning nature of comprehensive plans. <br />• Allows for no more than one off-street parking space per unit required. <br />• Prohibits public hearings on multifamily residential developments. <br />• Removes building height restrictions. <br />
