ORDINANCE _1013_ <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN ORDINANCE VACATING A DRAINAGE AND UTILITY EASEMENT WITHIN <br />THE PROPERTY LOCATED AT 8411 FAIRCHILD AVENUE IN THE CITY OF <br />MOUNDS VIEW <br />WHEREAS, Dale and Gayle Alexander (Alexanders), are requesting approval of the <br />Final Plat of Alexander Gardens. The project has included adjusting a common rear lot line of <br />two properties, one owned by the Ovxner,Alexanders and one owned by Todd Wilcox and <br />Laurie -Ann Wilcox (Wilcoxs); adding a new easement along the adjusted property line; and a <br />request by the Alexanders to have the 5-foot easement along the original property line, as <br />described on Exhibit A, (Original Easement) and includes easements for utilities, driveways and <br />parking, vacated by the City of Mounds View; and, <br />WHEREAS, the establishment of the new easement along the adjusted property lines to <br />be established in the plat know as Alexander Gardens, which will be executed by both the <br />Alexanders and the Wilcoxs, means that the Original Easement is no longer needed for a public <br />purpose; and, <br />WHEREAS, the City of Mounds View held a duly noticed public hearing on the <br />proposed vacation on April 25, 2024 and all persons desiring to be heard were provided <br />an opportunity to speak at the public hearing. <br />NOW, THEREFORE, THE CITY OF MOUNDS VIEW ORDAINS: <br />SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended to <br />include reference to the following Ordinance _1013_: <br />Subdivision 1. The City has made a determination that the land constituting drainage and <br />utility easement as described below is no longer needed for a public purpose, and as such, it is in <br />the public interest to vacate such portion of the drainage and utility easement described as <br />follows: <br />See Exhibit A <br />Subdivision 2. The drainage and utility capacity for which the to -be -vacated easement, as <br />described in Exhibit A, was established will be provided for in the new easement to be dedicated <br />to the public as part of the plat of Alexander Gardens. The proposed vacation of the easement <br />therefore will not adversely affect the ability of the City or other utility to maintain, repair, or <br />replace public utilities. <br />Subdivision 3. There are no apparent public utilities, buried or otherwise, within the <br />easements to be vacated. <br />Subdivision 4. The City Council finds that there is no longer a public need for the <br />Original Easement, to be vacated, as described in Exhibit A of this ordinance. <br />DOCSOPEN\MU210\320\941013.v2-3/21 /24 <br />
