City Council Staff Report <br />3//2024 <br />Page 3 <br />The email also explained that the Council encouraged the haulers to look to Blaine as a pricing <br />example and asked that the offer be presented to the City no later than 12:00 p.m. on March 21st. <br />The City again offered to meet with the haulers for any reason including to discuss options to <br />adjust services or other terms to assist in reducing pricing. The haulers requested, and the City <br />facilitated, a "hauler only" meeting on March 18, 2024. The haulers did not ask to meet with the <br />City. <br />On March 20, 2024, the City received an email from Christopher DeLaForest which delivered an <br />un-signed letter from "The Participating Waste Haulers Group" which is dated March 18, 2024. In <br />short, the letter states that the haulers will not provide a counteroffer without a change in the terms <br />and conditions, but then in closing indicates that the haulers will consider a price -only <br />counteroffer. In the letter, the haulers include the following: <br />• "We respectfully decline the city's invitation to re -submit our pricing offer at a lower price." <br />• "Without changes to the tentatively agreed upon terms and conditions of the underlying <br />contract, there can be no meaningful changes to price from us." <br />• The haulers offer a list of options for the City to consider in amending the terms and <br />conditions of the negotiated agreement. <br />• "We would be pleased to receive and consider either a counteroffer that amends the <br />terms and conditions of the tentative agreement or one that keeps those terms and <br />conditions and counters on price alone." <br />Staff Recommendation: <br />Staff recommends council review all documents, both resolutions and determine course of action. <br />Respectfully submitted, <br />Nyle Zikmund, City Administrator <br />Attachment: <br />1) Resolution 9890 to terminate negotiations <br />2) Resolution 9896 to continue negotiations <br />3) Proposed rates sheet <br />4) Proffered price adjustment <br />5) Updated table of rates form other cities <br />6) Spreadsheet of rates being paid by current residents <br />7) March 11, 2024 letter from C.
