RESOLUTION NO. 9920 (AMENDED) <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />A RESOLUTION REQUESTING A VARIANCE FROM STANDARD FOR STATE AID <br />OPERATION FOR PROJECT NO. S.A.P. 146-242-002 <br />WHEREAS, the City of Mounds View is preparing plans for Pleasant View Road at <br />Osborne Road (County Road 1) and ending at 73d Avenue (County Road H2); and <br />WHEREAS, Minnesota Rules for State Aid Operation 8820.9995 require minimum surface <br />width at 8 feet and shoulder/clear zone width at two feet; and <br />WHEREAS, the reasons for this variance request are based on upon completion of the <br />project, the post office installed the mailboxes on the Mounds View side of Pleasant View Drive, <br />which was constructed with a 8-foot shared use path with a 2-foot clear zone. After the mailboxes <br />were installed, the shared use path has a 7-foot surface width in lieu of the required ',ems than he <br />8-foot width and a 1-foot clear zone in lieu of the required 2-foot clear zone at the 9 mailbox post <br />locations, which it's prompting this variance request. <br />NOW, THEREFORE BE IT RESOLVED, that the City of Mounds View hereby request a <br />variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter <br />8820.9995 (Minimum Off -Road and Shared Use Path Standards) to allow less than 84 7-feet <br />of surface width and 1-foot of clear zone; <br />BE IT FURTHER RESOLVED, that the Mounds View City Council hereby indemnifies, <br />saves and hold harmless the State of Minnesota and its agents and employees of and from claims, <br />demands, actions, or causes of action arising out of or by reason of (project descriptions) in <br />accordance with Minnesota Rules 8820.9995 and further agrees to defend at their sole cost and <br />expense any action or proceeding commenced for the purpose of asserting any claim arising as <br />a result of the granting this variance. <br />BE IT FURTHER RESOLVED, that the Mayor and City Administrator are hereby <br />authorized and directed to execute all appropriate documents to effectuate the actions <br />contemplated by this resolution. <br />BE IT FINALLY RESOLVED that the Mayor and City Administrator, Staff and consultants <br />are hereby authorized and directed to take any and all additional steps and actions necessary or <br />convenient in order to accomplish the intent of this Resolution. <br />Original Resolution Adopted the 28th day of May, 2024.
