Rules Ch. <br />7030 as it may be amended from time to time. <br />(B) The following are exceptions to standards established in division (A) above: <br />(1) Noises not directly under the control of the property owner; <br />(2) Noises emanating from construction and maintenance activities between 6,00 a.m. and 10:00 p.m. on weekdays; and <br />(3) The noise of safety signals, warning devices and emergency pressure relief valves. <br />91.008 — Noise Control Regulations (Health and Sanitation; Nuisances) <br />(B) Loud or disturbing noises enumerated; restrictions. The following acts set forth in divisions (13)(1) through (B)(3) below <br />are declared to be loud, disturbing and unnecessary noises in violation of this section, but the enumeration shall not be deemed <br />to be exclusive: <br />(1) Construction or repairing of buildings. The erection, including excavating, demolition, alteration or repair of any building <br />between the hours of 10:00 p.m. and 7:00 a.m., Monday through Sunday. The City Administrator may grant authority for work to <br />occur at any time in the event of an emergency or when it is found that the activity would not affect the health, safety, comfort <br />and repose of persons in the vicinity; <br />(2) Nighttime noise in residential areas; parties. <br />(a) No person shall, between the hours of 10:00 p.m. and 7:00 a.m., participate in any loud party or gathering of people <br />from which noise emanates of a sufficient volume as to disturb the peace, quiet or repose of persons residing in any residential <br />area. <br />(b) Loud noises between the hours of 10:00 p.m and 7-00 a.m. of a volume as to be plainly audible at a distance of 100 <br />feet from the residential premises wherein a loud party or gathering is located shall be prima facie evidence of a violation of this <br />section. <br />50.006 — License to Haul Required (Garbage and Recycling) <br />(B) Operating requirements and restrictions. <br />(1) All licensees. All licensees shall comply with all of the following requirements and restrictions. <br />(a) Hours and days of operation. No hauler shall operate in a residential district after 6:00 p.m. or before 7:00 a.m. of any <br />day, and no hauler shall operate in a residential district on Sundays or legal holidays. Collection of solid waste for single-family <br />residences shall occur only on Thursdays, except when Thursday is a legal holiday. In the case of a legal holiday, the collection <br />will occur the following business day.
