Private or confidential identity and location data on a program <br />participant who submits a notice in writing that the participant is certified in the Safe at Home <br />address confidentiality program may not be shared with any other government entity or <br />disseminated to any person unless 1) the program participant has expressly consented in writing <br />to sharing the dissemination of the data for the purpose in which the sharing will occur; 2) the data <br />are subject to dissemination pursuant to a court order; 3) the data are subject to sharing pursuant <br />to Minn. Stat. § 5B.07, subd. 2; 4) the location data related to county of residence are needed to <br />provide public assistance or other government services, or to allocate financial responsibility for <br />the assistance or services; 5) the data are necessary to perform a government entity's health, safety, <br />or welfare functions, including the provision of emergency 911 services, the assessment and <br />investigation of child or vulnerable adult abuse or neglect, or the assessment or inspection of <br />services or locations for compliance with health, safety, or professional standards; or 6) the data <br />are necessary to aid an active law enforcement investigation of the program participant. <br />Regardless of whether certification has been submitted, the City must accept the address <br />designated by the Secretary of State as a program participant’s address and is subject to the <br />requirements contained in Minn. Stat. § 5B.05. <br /> <br />Sex Offender HIV Tests <br />CLASSIFICATION(S): Private <br />GOVERNING STATUTE: Minn. Stat. §§ 13.871, subd. 3(e), 609.3471 <br />DESCRIPTION OF DATA: Data that specifically identifies a victim who is a minor, in records or <br />reports relating to petitions, complaints or indictments made are private data on individuals, if <br />related to any of the following offenses: solicitation/inducement/promotion of prostitution, sex <br />trafficking, criminal sexual predatory conduct, and criminal sexual conduct in the first, second, <br />third or fourth degrees. <br />Undercover Buy Fund <br />CLASSIFICATION(S): Confidential/Private/Public <br />GOVERNING STATUTE: Minn. Stat. §§ 13.6905, subd. 13, 299C.065, subd. 4 <br />DESCRIPTION OF DATA: An application to the Commissioner of Public Safety for a grant <br />pursuant to Minn. Stat. § 299C.065 is a confidential record. Information within investigative files <br />that identifies or could reasonably be used to ascertain the identity of assisted witnesses, sources <br />or undercover investigators is a confidential record. A report at the conclusion of an investigation <br />is a public record, except that information in a report pertaining to the identity or location of an <br />assisted witness is private data. <br />
