to the requested collection.Extra Collection of Recyclables will be only offered during <br /> normal business hours,Monday through Friday. <br /> 2.2.8 Recycling shall be loaded and transported in such a manner as to be as inoffensive to <br /> the public as possible.All reasonable precautions shall be taken to prevent the spilling <br /> or scattering of Recyclables while loading or in transit. <br /> 2.2.9 Hauler shall not knowingly collect any Unacceptable Materials and shall have the right <br /> to refuse to pick up such Unacceptable Materials. Recycling Carts containing <br /> Unacceptable Materials shall be tagged by Hauler. If contamination is visible before <br /> the Cart is emptied,it shall not be emptied,and shall be tagged.Photo documentation <br /> should be taken if possible.If Hauler observes Unacceptable Materials from an RDU, <br /> Hauler must notify RDU that contaminated materials were included in the load and <br /> provide an educational tag regarding proper materials. Notwithstanding anything in <br /> this Contract to the contrary, title to and liability for Unacceptable Materials shall <br /> remain with the RDU at all times.Nothing in this Contract shall impose any obligation <br /> upon Hauler,its members,or its subcontractors to search the contents of any Cart,or <br /> other item(s)being collected,to determine if there is any Household Hazardous Waste <br /> contained therein. <br /> 2.2.10 Recyclables collected under this Contract shall be weighed on certified truck scales. <br /> Hauler will deliver all collected Recyclables to Eureka Recycling in Minneapolis, a <br /> Materials Recovery Facility(MRF),in a manner acceptable to the City.Hauler will not <br /> change its MRF(s)without notifying the City. <br /> 2.2.11 All Recyclable Materials placed for collection shall remain the responsibility and in the <br /> ownership of the RDU until picked up by Hauler,at which time title of the Recyclables <br /> shall pass to the respective Hauler. Hauler may subcontract Recyclables Collection <br /> services to another Hauler. <br /> 2.3 Yard Waste Collection Services <br /> 2.3.1 Hauler shall provide, as an Additional Collection Service Option, Yard Waste <br /> Collection from April 15tb through November 30th, weather, and availability of a <br /> Composting Facility permitting, for RDUs that subscribe(either for a full season or <br /> pay-per-bag).RDUs shall contact their Hauler to sign up for Yard Waste Collection. <br /> Yard Waste Collection is an Additional Collection Service Option for RDUs and shall <br /> be provided for the fees indicated in Exhibit A.When an RDU initiates Yard Waste <br /> Collection,the RDU shall be billed the additional fee(s)on the next quarterly invoice. <br /> Hauler may advertise to RDUs that Hauler will provide additional Yard Waste <br /> Collection services.Any advertising must be approved by the City prior to publicizing <br /> (e.g.,printing,electronic distribution,social media,etc.). <br /> 2.3.2 RDUs must prepare Yard Waste for collection in Compostable Bags,Hauler-provided <br /> Carts,or both.If an RDU does not subscribe to a full season of Yard Waste Collection, <br /> Yard Waste Collection can be purchased through a"pay per bag"option by the RDU <br /> contacting their Hauler. <br /> A-10 <br /> MU210\313\963095.v4 <br />
