apprenticeship. <br /> 13.2 Minnesota Government Data Practices Act Compliance <br /> Data provided,produced,or obtained under this Contract shall be administered in accordance <br /> with the Minnesota Government Data Practices Act,Minnesota Statutes,Chapter 13.Within <br /> one business day,Hauler shall report to the City any requests from third parties for information <br /> relating to this Contract. Hauler agrees to promptly respond to inquiries from the City <br /> concerning data requests. <br /> 13.3 Audit <br /> All books,records,documents and accounting procedures and practices of Hauler relevant to <br /> the Contract shall,pursuant to Minnesota Statutes, Section 16C.05,subdivision 5,be subject <br /> to examination at all times by the City and/or by the Legislative Auditor or State Auditor for a <br /> minimum of six(6)years. The Hauler shall maintain such records for a minimum of six(6) <br /> years after final payment. <br /> 13.4 Americans with Disabilities Act Compliance <br /> Hauler agrees to comply with the Americans with Disabilities Act(ADA)of 1990,the ADA <br /> Amendments Act of 2008 (ADAAA), and Section 504 of the Rehabilitation Act of 1973. <br /> Hauler shall not discriminate on the basis of disability in the admission or access to, or <br /> treatment of employment in its services,programs,or activities.Hauler agrees to hold harmless <br /> and indemnify the City from costs,including but not limited to damages,attorney's fees,and <br /> staff time,in any action or proceeding brought alleging a violation of the ADA,the ADAAA, <br /> and/or Section 504 caused by Hauler. <br /> 13.5 Minnesota Human Rights Act Compliance <br /> Hauler acknowledges that the Services under this Contract are Public Services and agrees to <br /> comply with the Minnesota State Human Rights Act,Minnesota Statutes,Chapter 363A. <br /> 13.6 Conflict of Interest <br /> Hauler agrees that no member,officer,or employee of the City shall have any interest,direct <br /> or indirect,in the executed Contract or the proceeds thereof.In the event that such a conflict is <br /> discovered, the Parties will work together to identify all means to eliminate such conflict. <br /> Violation of this provision may cause the executed Contract to be null and void and Hauler <br /> will forfeit any payments to be made under the executed Contract to the extent such payments <br /> were made during the existence of such conflict. <br /> 14 Liquidated Damages <br /> Hauler agrees that,in addition to any other remedies available to the City,the City may impose <br /> liquidated damages to Hauler in the amounts specified below as liquidated damages for failure <br /> of Hauler to fulfill its obligations.The City will notify the Hauler in writing documenting the <br /> nature of the violation,the history of the account,if any,and the reason for the imposition of <br /> A-32 <br /> MU210\313\963095.v4 <br />
