CHAPTER 92: PARKS AND RECREATION <br /> Section <br /> 92.001 Purpose <br /> 92.002 Definitions <br /> 92.003 Construction and scope <br /> 92.004 Hours and access <br /> 92.005 Permits <br /> 92.006 Special activities <br /> 92.007 General conduct <br /> 92.008 Traffic rules <br /> 92.009 Additional rules and regulations <br /> 92.999 Penalty <br /> §92.001 PURPOSE. <br /> This chapter is enacted to govern the conduct of members of the public during their use and enjoyment of the city's open <br /> space system so as to further the safety,health, enjoyment and welfare of all persons in the use of those facilities and to <br /> protect public property and resources for posterity. <br /> (Prior Code,§909.01) (Ord.557,passed 03-27-1995) <br /> §92.002 DEFINITIONS. <br /> For the purpose of this chapter,the following definitions shall apply unless the context clearly indicates or requires a <br /> different meaning. <br /> DEPARTMENT.The City of Mounds View Parks and Recreation Department. <br /> DIRECTOR.The Director of Parks and Recreation.The person authorized by the City Council to direct the Department of <br /> Parks and Recreation. <br /> LAW ENFORCEMENT OFFICER.Any person duly deputized or commissioned by the city, Board of County <br /> Commissioners or the state for the purpose of enforcing the laws, ordinances and regulations of their respective <br /> jurisdictions. <br /> MOTOR VEHICLE. <br /> (1) Every vehicle which is self-propelled and does not derive its power from overhead wires. <br /> (2) MOTOR VEHICLES include,but shall not be limited to,automobiles,trucks, motor bikes, mini bikes,all-terrain <br /> vehicles and snowmobiles,with the exception of battery powered wheelchairs. <br /> OPEN SPACE SITE.Any park,reserve,special use area, golf course,linear park or any other area owned, improved <br /> maintained,operated or otherwise controlled by the city for recreation and natural resource preservation purposes. <br /> OPEN SPACE WATERS.Any public shoreline owned by or under the authority of the city. <br /> PARK.Any area designed or used for active or passive recreation and which is owned,operated or controlled by the city <br /> or controlled by another government unit. <br /> PARK SYSTEM.The city's park system which includes the sites and facilities owned, maintained and operated by or <br /> otherwise under the authority of the city. <br /> (Prior Code,§909.02)(Ord. 557, passed 03-27-1995) <br /> §92.003 CONSTRUCTION AND SCOPE. <br /> In the interpretation of this chapter,all provisions contained are to be construed as follows. <br /> (A) Any requirement or prohibition by any provision extends to and includes the causing, procuring,aiding or abetting <br /> directly or indirectly,of such acts;and the permitting or allowing any minor by the responsible parent,guardian or custodian <br /> to commit any such act. <br /> (B) No provision shall make unlawful any act necessarily performed by any law enforcement officer or Department <br /> employee in the line of duty or work as such, or by any person,that person's agents or employees, in the proper and <br />
