PERMIT AGREEMENT <br />between the <br />BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL <br />and <br />BOULDER CONTRACTING <br />THIS AGREEMENT, is made and entered into this 15t" day of January, 2025, by and <br />between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL, a <br />municipal corporation under the laws of the State of Minnesota, (the `Board"), acting through its <br />Saint Paul Regional Water Services General Manager ("SPRWS General Manager"), and <br />Boulder Contracting, a Minnesota Limited Liability Company, whose registered office address is <br />16522 Wake Street, NE, Ham Lake, Minnesota (the "Permittee"). <br />WITNESSETH: That the Board, for itself, its successors and assigns, and Permittee, for <br />itself, its successors, and assigns, do hereby agree as follows: <br />1. Permittee is hereby permitted to enter upon certain Board -owned rights -of way situated in the <br />Lot 3, Block 1, Long Lake Cove, Ramsey County, Minnesota, where it is adjacent and <br />contiguous to the Permittee's property (the "Premises"), and to thereupon install and <br />maintain the following improvements: <br />a.. A driveway surface in from County Road 1, including a reinforced concrete <br />protective pad, details of which are shown in Exhibit"A" attached hereto and <br />incorporated herein. The location of which is shown on Exhibit "B attached <br />hereto and incorporated herein. <br />2. Permittee must pothole each of the raw water conduits at the points of crossing to verily <br />depth. <br />3. The usual and customary administration fee shall be waived. <br />4. Routine operations of the Board shall take precedence over all Permittee activity included in <br />this Agreement. <br />5. Permittee shall notify the Board's representative at least 48 hours in advance of permitted <br />activities. The Board's representative, Mike Knutson, can be reached during normal worl<ing <br />days at (cell) 651-775-6192 between the hours of 8:00 a.m. and 3:30 p.m. <br />6. The Board shall. have the option and authority of assigning its inspector or inspectors to the <br />site at any time and for such periods as the Board or its engineer deems necessary or <br />expedient for the safety and protection of employees or works of the Board or of other <br />persons or property whomsoever or whatsoever because of any condition arising out of said <br />permitted activity or from acts or operations of Permittee in the operation within the <br />Premises. <br />Pa;;c I ol'i <br />
