Item No: 08E <br />MOLADS VIEW Meeting Date: January u 20ss <br />Type of Business: Council Business <br />City Administrator Review: <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Resolution 10041, Authorizing abatement of junk/hazards at <br />8391 Spring Lake Road <br />Introduction: <br />In response to complaints, staff has investigated alleged junk/hazards located on the <br />exterior of the property located at 8391 Spring Lake Road — Richard Mitchell residence. <br />Code Official Schoeman inspected the property in May, 2024 and issued corrective <br />actions in writing on May 20, 2024. A deadline was established of June 27, 2024. <br />Code Official Schoeman re -inspected the property in late July and found no action had <br />been taken and issued another letter dated July 25, 2024 providing a deadline of August <br />29, 2024. The letter detailed failure to comply would result in the City taking all <br />necessary steps to remediate the situation, including abatement which costs would be <br />born by the property owner. <br />Administrator Zikmund received public information disclosure request from the property <br />owner immediately north and adjacent to 8391 regarding any and all documents relating <br />to cleaning up the property. The requester also provided additional photos as evidence <br />no clean up had occurred. Administrator Zikmund conducted a drive -by inspection on <br />January 9, 2025 of was able to view/observe items/junk in both the front yard (north <br />side) and in the back yard. <br />A letter was sent to Richard Mitchell, the property owner at 8391 Spring Lake Road <br />advising him of the violation and advising the council would be taking action at their <br />January 27, 2025 council meeting to move forward with abating the hazard. <br />Discussion: <br />Council has two remedies to address the situation, abatement and/or criminal charges. <br />The abatement process gives us legal authority to enter the property and remove the <br />"junk" materials, and assess all costs to the property owner. Failure to pay would result <br />in assessment directly to the property. <br />Council can also direct staff to initiate criminal charges which would occur through our <br />prosecuting attorney and has been done in the past (Halverson properties) <br />Strategic Plan Strategy/Goal: <br />A progressive city that is welcoming and desirable destination to all ages and cultures, <br />who seek progress through partnership, and a place where residents can live, work and <br />play safely and show pride in the community. <br />
