RESOLUTION NO. 10041 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />ORDERING THE ABATEMENT OF HAZARDOUS CONDITIONS AT <br />8391 SPRING LAKE ROAD IN THE CITY OF MOUNDS VIEW <br />WHEREAS, City officials received complaints from adjacent neighbor regarding <br />improper/unlawful storage of "junk" at 8391 Spring Lake Road in 2024 and prior; and <br />WHEREAS, based upon an investigation/inspection of the residence, it is <br />recommended that the hazard/junk be abated; <br />WHEREAS, staff provided written notice to the property owner on May 20, 2024 <br />establishing a re -inspection to occur in June, 2024. A reinspection occurred and a <br />corrective letter was sent on July 25, 2024, advising failure to comply by August 29, 2024 <br />would result in the City taking necessary action; and <br />WHEREAS, Minnesota Statutes, Section 463.161, and Mounds View City Code <br />91.003 Subd. C. 3 authorizes the governing body of any City or town to correct or remove <br />the hazardous conditions of any hazardous buildings or property. <br />NOW, THEREFORE BE IT RESOLVED that the Mounds View City Council agrees <br />as follows: <br />The City of Mounds View finds that the property at 8391 Spring Lake Road in the <br />City of Mounds View is in violation of Code Section 91.003 Subd. C.3 — outside <br />piling/storage of junk. <br />2. The hazardous condition at the foregoing address constitutes a public nuisance <br />within the meaning of Minnesota Statutes. <br />3. An Abatement Order shall be served upon the property/property owners. <br />4. The City Attorney and City Prosecuting attorney are authorized to take all <br />necessary legal steps to secure compliance with the Order and to obtain <br />authority to remove the hazardous condition by court order or consent and <br />assess the costs thereof against the property <br />Adopted this 27th day of January, 2025. <br />t <br />)�!� strom, Mayor <br />ATTEST: <br />Nyle ikm ty Administrator <br />
