8.0 IMPLEMENTATION
8.1 OFFICIAL CONTROLS
As noted in Section 3.1, It is the City's intent to adopt by reference and enforce RCWD's Rules C, D, E,
and F and for the City to accept the authority and responsibility to implement the Wetland Conservation
Act (WCA) in the City. The City will enter into a MOU with the RCWD for the City to adopt ordinances that
adopt RCWD's Rules C, D, E, and F by reference within 180 days of RCWD approval of the LSWMP and
for RCWD to no longer assert its authority for those rules. The City understands that if these actions are
not completed within 180 days of RCWD's approval of the LSWMP, RCWD will continue asserting its
authority for RCWD Rules C, D, E, and F and serving as the WCA LGU in the City.
The RCWD will no longer apply its authority for Rules C, D, E, and F within the City but will continue
administering the remaining RCWD rules in the City, which will require permits with RCWD. The City will
work with the Board of Water and Soil Resources (BWSR) on resolutions for the City to accept the
authority and responsibility to implement WCA in the City.
In the event of inconsistent or conflicting standards, the stricter standard will prevail. From the
assessment of the City's official controls presented in Table 6.1, Table 8.1 identifies the implementation
actions necessary to address this action.
Table 8.1 — City Code Implementation Actions
=
Construction Site and Land Disturbance
Update within 180 days of RCWD approval of the
Runoff Control
LSWMP to adopt RCWD Rule D by reference and to
comply with MS4 permit.
Update within 180 days of RCWD approval of the
Post Construction Site Runoff Control
LSWMP to adopt RCWD Rule C by reference and to
comply with MS4 permit.
Update within 180 days of RCWD approval of the
Flood Plain Management
LSWMP to adopt RCWD Rule E by reference and to
comply with MS4 permit.
Update within 180 days of RCWD approval of the
Wetlands and Public Waters
LSWMP to adopt RCWD Rule F by reference and to
comply with MS4 permit.
8.2 SURFACE WATER SYSTEM OPERATION AND MAINTENANCE
Mounds View's existing surface water management system is a major investment for the City. The
ongoing maintenance of this existing surface water management system is critical to protecting this
valuable investment. The City's surface water system maintenance responsibilities and the schedule for
these responsibilities are included in Table 8.2:
City of Mounds View 44
Local Surface Water Management Plan } } Stantec Project No. 193804166
