Mounds View City Council Page Seven <br />�egular Meeting June 28, 1993 <br />The applicant should be allowed to put the addition on the garage and make <br />good use of it . <br />Paul Harrington commented that Mr. Setterholm would be using a portion of <br />the garage to store a boat. <br />Dave Petri, 2750 Hodges Lane, stated that he would like to apologize to Mr. <br />Setterholm because in the beginning Mr. Petri had told the applicant that he <br />would support him in the request for a conditional use permit for an <br />oversized garage until he became aware of the size of the structure. This <br />structure would diminish Mr. Petri's view of the neighborhood. <br />The applicant, Mr. Setterholm, was present at the meeting but had no <br />comments to make. <br />Councilmember Rickaby stated that she has been liaison on the Planning <br />Commission for a short while and she has observed more persons coming in to <br />get permits to increase the size of their garages for the storage of boats <br />and so forth. Rickaby stated that this is a sign of the times because <br />people have more items to store. An alternative for the applicant might be <br />to keep the boat outside and this would also obstruct the view. The view <br />would be better served by housing the boat and keeping it sheltered from <br />�ear and tear at which time it would become a nuisance and a bad site. <br />ouncilmember Rickaby stated that she supports the ability of per.sons to <br />build garages of substantial size to house boats. <br />Mayor Linke stated that a conditional use permit is not a variance and asked <br />if the applicant met all laws required? <br />Paul Harrington replied that the applicant had m�t all requirements. Mr. <br />Harrington indicated that a conditional use permit is granted ior a <br />principal use which requires special limitations in order to protect the <br />public welfare. A true variance would be when an applicant would ask for a <br />variance from the code. The City keeps track of issued conditional use <br />permits because the City does not want to encourage small businesses taking <br />place in these oversized garages. <br />Mayor Linke closed the public hearing at 7:27 p.m. <br />MOTIONLSECOND: Rickaby/Blanchard to adopt Resolution No. 4379 Regarding <br />Request for Conditional Use Permit.(Oversized Garage) 7312 Park View Drive, <br />Planning Case No. 364-93 <br />Mayor Linke stated that the applicant has met all code requirements, <br />therefore, the City is bound legally to grant the permit. The City has no <br />legal grounds to deny the request. <br />VOTE: 5 ayes 0 nays Motion Carried <br />� <br />
