unds View City Council <br />lar Meeting <br />Page Six <br />June 24, 1991 <br />Mayor Linke stated that all licenses should be approved contingent upon <br />completion of requirements or corrections within 30 days of the date of <br />their approval. <br />Mr. Ron Michna stated that his belief regarding the liquor licensing was <br />that when legislature set up the Sunday Sales for food establishments it <br />was meant that these establishments sell food all week in order to sell <br />liquor on Sunday. Councilmember Blanchard also stated that the intent was <br />that these establishments serve food as well as the sale of liquor. <br />Mayor Linke stated that in the past the City had required these <br />establishments to submit a menu. <br />Samantha Orduno, City Admininstrator, commented that she had walked into <br />Robert's Off 10 at approximately 5:00 p.m, today and noticed there was no <br />one sitting at the tables. Orduno asked for a menu and was advised that <br />there are no menus. Orduno was also advised that they sometimes have hot <br />dogs on Sundays. <br />Mr. Bill Frits, 8072 Long Lake Road, stated that the City has heard the <br />same complaints year after year regarding Robert's Off 10. Mr. Frits <br />stated the City should take a stand and not issue a license until the <br />~tablishment was in conformance; don't issue under contingency. <br />Mayor Linke stated that Mr. Waste has little control aver activities beyond <br />his property. Linke also stated that in regards to the signs, they have <br />nothing to do with his license, nor does the berm. These are more safety <br />issues and zoning issues rather than licensing issues. Mayor Linke <br />appreciates the comments from the residents and these are things to keep in <br />mind when Mr. Waste advises the City of his outdoor concerts. <br />City Attorney Karney advised the Council that these licensees are required <br />to meet certain conditions in order to obtain a license such as insurance, <br />current property taxes, current utilities , fire inspections, and health <br />inspections. These are minor issues and the City would be setting itself <br />up for a lawsuit if it did not allow these licensees to have a period of <br />time to meet these conditions. <br />Councilmember Quick further stated that the City did deny a license in the <br />past and was sued by the establishment. The City did win in that suit, but <br />the circumstances were very different and involved more than just the <br />licensing requirements. <br />City Attorney Karney explained that these comments that are being heard <br />from the residents regarding the establishments are complaints rather than <br />factors that would affect the license for the establishment. These <br />complaints should be reported to the Police Department and then to the City <br />~orney's office. The complaints are not grounds for taking away a <br />sense from an establishment. <br />
