Mounds View City Council Apri124, 2000 <br />Regular Meeting Page 9 <br />5418, the City Council resolution of approval. He indicated the resolution has been broken down <br />into three sections. He explained that the first "NOW Therefore Be it Further Resolved" clause <br />refers to the development review which is formulated to the site plan, and the second clause <br />refers to the conditional use permit, which also addresses the 400 square-foot accessory building. <br />He advised that the last clause on the last page of the resolution addresses the wetland buffer <br />permit, and that section of the resolution stipulates that the applicant shall obtain approval from <br />the Rice Creek Watershed District and a National Pollution Elimination Discharge System permit <br />from the Minnesota Pollution Control Agency. He advised that this is an administrative type of <br />permit, which the contractor would be required to obtain to verify that the erosion control <br />measures are in place, and these permits are typically not denied. <br />Planning Associate Ericson stated staff recommends approval of Resolution 5418, with <br />stipulations. He proved the Council with a brief overview of the site plan. He indicated that to <br />the south of the existing building, in the location of the expanded area, a portion of the parking <br />lot in would remain until such time as the future expansion takes place. <br />Bob Mills, 2817 County Road H2 stated his home was located to the north of the Church. He <br />inquired if the lights at the facility would remain on all night long, or if they would only be <br />utilized during services at the Church. <br />Gary O'Malley, 7432 Bacon Drive, Fridley stated he has been a member of the Church for many <br />years. He explained that the lights at the facility are on timers, and can be set. He indicated the <br />lights are presently left on all night as a security measure. He stated this comment had come <br />forward at the meeting that was recently held with all of the neighbors, and the Church indicated <br />the lights could be turned off at 10:30 p.m., which appeared to be acceptable to the residents in <br />attendance. He indicated the lights nearest the building would probably be left on for security <br />purposes, however, the rest of the lights could be turned off. <br />Mr. O'Malley stated the only other comment the residents brought forward during the meeting <br />was with regard to the south side of the site, where they would prefer to have fewer hardwoods <br />and more evergreens. <br />There was no further public input. <br />Mayor Coughlin closed the Public Hearing at 7:44 p.m. <br />MOTION/SECOND: Quick/Thomason. To Approve Resolution No.5418, a Resolution <br />Approving a Conditional Use Permit, Development Review and Wetland Buffer Permit Request <br />for Messiah Lutheran Church Located at 2848 County Road H2; Planning Cases CU00-001, <br />DED00-001 and WB00-001, as Amended to Stipulate that a Privacy Fence be Constructed Along <br />the Northern Portion of the Site, and to Attempt to Maximize the Privacy Fence as per the Code, <br />and Grant Staff Discretion in that Regard. <br />• Council Member Thomason stated she would make a friendly amendment pertaining to the <br />privacy fence, m response to the resident at 2850 County Road H2.
