Mounds View City Council January 22, 2001 <br />Regular Meeting Page 13 <br />Mayor Sonterre closed the public hearing at 8:38 p.m. <br />MOTION/SECOND: Thomas/Stigney. To Waive the Second Reading and Approve Ordinance <br />674, an Ordinance Amending Chapter 1005 of the Mounds View Municipal Code Pertaining to <br />the Housing Code. <br />Council Member Marty thanked Housing Inspector Jeremiah Anderson for all his work on the <br />Ordinance. <br />ROLL CALL: Quick -Aye/Marty -Aye/Stigney -Aye/Thomas -Aye/Sonterre -Aye. Motion <br />carried unanimously. <br />D. Appeal of Planning Commission Denial of a Variance Request by John <br />Wilson, 7764 Greenwood Drive, Planning Case VR00-008. <br />Community Development Director Ericson explained Mr. Wilson had applied for a variance for a <br />garage addition built without any setback to the side property line which was constructed without <br />a permit. Staff was made aware of the garage addition when neighbors called to complain and <br />has been communicating with Mr. Wilson over the summer. The Planning Commission denied <br />the request in December as it did not meet the variance requirements. <br />Mr. Wilson has requested an appeal of the decision of the Planning Commission. Staff has since <br />spoken with Mr. Wilson and he has considered the possibility that a compromise could be made. <br />There is ten feet between the structure and the property line. Mr. Wilson indicated he could <br />move the structure to within four feet of the property line. Staff asked him to move the structure <br />to five feet from the property line eliminating the need for a variance. Mr. Wilson has agreed to <br />do so and based on the agreement reached is not at this meeting. <br />Staff recommends Council deny the appeal to provide formal closure to this matter upholding the <br />Planning Commission decision. Mr. Wilson intends to make changes to the structure and is no <br />longer seeking an appeal for the full structure. Staff has drafted a resolution denying the appeal <br />if Council wishes to consider it this evening or it can be added to the next meeting agenda. <br />Mayor Sonterre inquired as to whether Mr. Wilson had given an indication as to how soon he <br />will make the corrections to the structure. <br />Community Development Director Ericson stated Mr. Wilson had not indicated when he <br />intended to make the corrections to the structure. The resolution drafted by Staff goes through <br />the chronology of events of this case and goes through the findings to support the Planning <br />Commission decision. It also requires Mr. Wilson to bring the structure into compliance with <br />building and zoning codes within 30 days of the date of the resolution. <br />Council Member Thomas questioned whether the City is creating a hardship by requiring Mr. <br />Wilson to do construction in February. <br />
