Mounds View City Council July 8, 2002 <br />Regular Meeting Page 4 <br />• <br />Mayor Sonterre asked if it was necessary to have two separate contracts with Will Kill, one for <br />the Community Center and one for City Hall. <br />Public Works Director Lee indicated there would need to be two completely separate contracts <br />and noted there would be no cost savings to the City to have one contract. <br />Ayes - 4 Nays -1(Stigney) Motion carried. <br />7. COUNCIL BUSINESS <br />A. Public Hearing to Consider the Martin Harstad Request to Rezone 66 Lots <br />within the Red Oak Estates No. 3 Subdivision from R-1, Single Family <br />Residential, to R-3 Medium Density Residential. <br />Mayor Sonterre opened the public hearing at 7:23 p.m. <br />Community Development Director Ericson reviewed his staff report with Council and provided <br />Council with a history of the property in question. <br />Director Ericson indicated that Martin Harstad, representing Keith Harstad had requested <br />rezoning of the lots originally platted in 1974. <br />Director Ericson indicated the lots were originally platted in 1974 and at that time the applicant <br />received a special use permit to construct townhomes in an R-1 district. <br />Director Ericson indicated that in 1977 the City's zoning code underwent a revision and, while <br />the zoning did not change, townhomes were no longer allowed in an R-1 district. <br />Director Ericson indicated that in 1983 the Harstads had applied for a rezoning to R-3 to continue <br />with construction but that request was denied. <br />Director Ericson indicated the Harstads had applied for building permits in 1995 but they were <br />denied because townhomes are not allowed in an R-1 district. Shortly thereafter litigation ensued <br />and it continues. <br />Director Ericson indicated the Planning Commission had reviewed this request had held a public <br />hearing to take comment from residents. He then indicated that, based on resident feedback and <br />an assessment that the project would have a negative impact on the neighborhood the Planning <br />Commission has recommended denial. <br />Director Ericson indicated the Planning Commission's primary reason for denial is that it would <br />adversely impact the neighborhood and, with regard to those accessing off of Greenwood Drive, <br />• would alter the existing character of the neighborhood. <br />
