Mounds View City Council December 9, 2002 <br />Regular Meeting Page 7 <br />• Council Member Thomas indicated that she felt Council had been clear with regard to the <br />fireworks fee that there was not to be any disposal charge included. <br />Chief Zikmund indicated that the decision was up to Council but he had recommended a $200.00 <br />charge for disposal to deal with those fireworks purchased legally but illegally used. <br />Council Member Thomas indicated she would want to charge the costs back to the person with <br />the violation and not add a fee for those that intend to use them properly. <br />Chief Zikmund indicated he was not sure the City could charge back the costs to minors. <br />City Attorney Riggs indicated it would depend on how the case is charged out and then <br />recommended that he and the Fire Chief discuss the matter further. <br />Council Member Thomas indicated she was sure that Council had been clear that no disposal fee <br />was to be included in the permit fee. <br />Chief Zikmund indicated he had made the recommendation but the ultimate decision is up to <br />Council as it is the City's fee. <br />Mayor Sonterre suggested removing the disposal fee to make the permit fee $550.00. <br />• Chief Zikmund indicated that if the City is unable to collect the costs of disposal the City would <br />be paying out of its budget. <br />Council Member Thomas asked whether the City needed to indicate that the penalty is $100.00 <br />plus the disposal costs. <br />City Attorney Riggs indicated that costs can be handled as part of the criminal case for <br />restitution. <br />Mayor Sonterre commented that the cost to pursue collection of the disposal costs could exceed <br />the disposal costs. <br />Council Member Marty asked if the City could use the $200.00 as a deposit to be returned at the <br />end of the season if there is no violation. <br />Council Member Thomas indicated she was not sure how the City would define season. She <br />then said that she has trouble charging a fee for illegal activity to those doing things legally. <br />Mayor Sonterre asked whether the $200.00 built into the $750.00 was for vendors. <br />Chief Zikmund indicated that the $200.00 was arbitrarily arrived at based on research into the <br />costs of disposal. He then indicated that fireworks are 98% paper so they are soaked in water and <br />then weighed for a per pound disposal cost. <br />
