She stated the applicant constructed <br />this driveway without a permit, and is requesting to be able to leave it there because it is <br />patterned, and to remove part of it would disturb the patterning. <br />Mayor Linke stated the applicant had appeared ten years ago before the Council with the same <br />request and was turned down. <br />Council Member Marty stated that due to the fact this was constructed without a permit and <br />exceeds the maximum curb cut width, he concurs with the Planning Commission 100 percent. <br />Mayor Linke closed the public hearing at 7:53 p.m. <br />MOTION/SECOND. Stigney/Many. To waive the reading and approve Resolution 6322, <br />affirming the Planning Commission's denial of the variance requested at 7090 Silver <br />Lake Road. <br />Council Member Stigney stated he agrees with the Planning Commission's recommendation. <br />• Ayes-5 Nays-0 Motion carried. <br />D Introduction and First Reading of Ordinance 750, Vacating Easements <br />Related to Hidden Hollow Final Plat <br />Planning Associate Prososki stated the easements are unnecessary because the utilities and <br />highway were never put in place, the utilities that were in place in some areas are being relocated <br />due to the development, and that Hidden Hollow's final plat dedicated the necessary easements <br />for the utilities that will be put in place. She stated the Second Reading is scheduled for August <br />23rd. <br />Council Member Marty asked where the remaining easements are going to be, and Planning <br />Associate Prososki stated she could attach that map with the Second Reading. She stated that <br />basically all the easements on the bottom of the page are going to be covered by a new easement <br />that covers ponding in that area. <br />MOTION/SECOND: Marty/Quick. To waive the reading and adopt the First Reading of <br />Ordinance 750, Vacating Easements Related to Hidden Hollow Final Plat. <br />Ayes -5 Nays - 0 Motion carried <br />• E.
