Mounds View City Council September 13, 2004 <br />Regular Meeting Page 4 <br />• Council Member Stigney stated it would go back to the Charter Commission. <br />Jonathan Thomas, Chair of the Charter Commission, stated that it would not go to a ballot, and it <br />would go back to them with a request for some modification or with some request to rework a <br />section, and then they would re-present it for a unanimous ballot. <br />Mayor Linke stated he did not foresee a problem with it since it passed unanimously on the first <br />vote. <br />City Clerk/Administrator Ulrich added that this is a total rewrite of Chapter 5, and that the City <br />Attorney had reviewed it in terms of form and consistency with state statute, and it met with his <br />approval. <br />Mayor Linke closed the public hearing. <br />B. 7:10 pm: Public Hearing for Second Reading and Adoption of Ordinance 742, Amending <br />Section 2.06 of the City Charter regarding Mayor's Powers and Duties. (Roll Call Vote) <br />Mayor Linke opened the public hearing. <br />Mayor Linke stated that this basically added one sentence. <br />• Council Member Marty stated he thought it was excellent. <br />Mayor Linke stated he had no problem with it. <br />Mayor Linke closed the public hearing. <br />C. 7:15 pm: Public Hearing for Second Reading and Adoption of Ordinance 748, Amending <br />Section 4.05 of the City Charter regarding Vacancy of Municipal Elected Office. (Roll Call <br />Vote) <br />Mayor Linke opened the public hearing. <br />Mayor Linke stated the word "highest" was added, and the sentence, "Candidates filling a <br />vacancy shall take office before the next regularly scheduled Council meeting following election <br />certification." He stated there is one Council member running for Mayor in this election, and he <br />asked Mr. Thomas whether this would take effect if he is elected. <br />Mr. Thomas stated that this change would be nothing in that case because there isn't an open seat <br />until he is elected, and because that seat is not open now, that would force a special election. He <br />stated there are questions about when and why we would have to have a special election, which <br />aren't being addressed here. <br />• Mayor Linke closed the public hearing. <br />
