Mounds View City Council September 13, 2004 <br />Regular Meeting Page 6 <br />• Mayor Linke opened the public hearing. <br />Director Ericson stated that this is the second reading of Ordinance 752. He stated that the City <br />Council had directed Staff and the Planning Commission to review the Zoning Code relating to <br />driveway setbacks, and that currently there is a one-foot allowance. He stated that there have <br />been some issues with that. He stated the Planning Commission has looked at the Code and is <br />recommending some language that would bring the setback of driveways back to five feet in <br />residential districts, and if a variance is needed or a shorter setback, the applicant would need to <br />go through the variance procedure through the Planning Commission. <br />Council Member Marty stated there had been a potential of a neighbor being coerced, so he <br />thought that this would clean it up. <br />Mayor Linke closed the public hearing. <br />MOTION/SECOND. Marty/Stigney. To waive the reading and adopt Ordinance 752, an <br />Ordinance Amending the Zoning Code Relating to Driveway Setbacks. <br />ROLL CALL. Linke/Marty/Stigney/Gunn. <br />Ayes-4 Nays-0 Motion carried. <br />• G. Second Reading and Adoption of Ordinance 746, an Ordinance Implementing a Franchise <br />Fee on Xcel Energy Electric and Natural Gas Operations within the City of Mounds View <br />for the Year 2005. (Roll Call Vote) <br />Mayor Linke stated that this is the 4 percent franchise. <br />MOTION/SECOND. Marty/Gunn. To waive the reading and adopt Ordinance 746, an Ordinance <br />Implementing a Franchise Fee on Xcel Energy Electric and Natural Gas Operations within the City of <br />Mounds View for the Year 2005. <br />Council Member Stigney stated that this continues to be the 4 percent that has been in effect last year <br />and previous years on electric and gas in the city. <br />Council Member Marty stated that there is a sunset clause that will automatically sunset on December <br />31, 2005. <br />ROLL CALL. Linke/Many/Stigney/Gunn. <br />Ayes-4 Nays-0 Motion carried. <br />H.
