Mounds View City Council Apri125, 2005 <br />Regular Meeting Page 6 <br />• dollars for both the City and its constituents if they remain consistent and follow the criteria and <br />if a criterion has not been established, listen to the residents until one is established. <br />Mayor Marty opened the public hearing. 9:03 p.m. <br />Chuck Sopher, 8386 Pleasant View Drive, stated that he lives two houses away from the <br />applicant. He clarified that this is nothing personal stating that all of the neighbors closest to this <br />house oppose the permit. He asked why the ordinance is in place if it is not going to be adhered <br />to. He stated that any time someone new moves into the area it is their responsibility to become <br />familiar with the City ordinances before purchasing the home. He stated that all of this <br />information is available on the City Website, clearly stating that only two dogs are allowed. He <br />expressed frustration stating that he does not see a reason to issue the permit when all of the <br />neighbors closest to this house are in agreement and do not want the permit approved. He stated <br />that he can accept what he already knows about the neighborhood adding that they are the most <br />affected and it is their hope that the Council is representing them in this matter. <br />Ann Johnson, 8371 Pleasant View Drive, stated that she lives across the street from the <br />applicant. She indicated that the dogs are barking a lot less in the last few weeks noting that she <br />can hear the dogs barking inside the house. She expressed concerns that their barking would get <br />worse this summer. She stated that she spoke with a neighbor from a different area and when she <br />mentioned her street the resident was familiar with the street. She stated that the resident told her <br />they do not walk down Pleasant View Drive due to the number of dogs. She referenced the <br />• criteria mentioned by the Fishers stating that if the City does not have any written criteria to grant <br />or remove a permit, leaves them in a bad state. She urged Council to get criteria in place to deal <br />with these issues and asked if she should contact the police if she has a problem with the barking. <br />Mayor Marty explained that as the Mayor neither he nor the City Council receive calls or <br />complaints. He stated that the calls are made to City Hall and Staff notifies them if there is a <br />potential problem. <br />Council Member Thomas explained that the criteria used is outlined and set by the language in <br />the resolution itself. She further explained that if the criteria outlined in the resolution is not <br />adhered to that this is what they would be judged against if this issue comes up again. <br />Ms. Johnson clarified that the Planning Commission stated two dogs not three would be allowed. <br />She noted that she is willing to wait to see if the dogs acclimate and settle down. <br />Ms. Prososki clarified that the resolution stipulates that the applicant would be limited to three <br />dogs. <br />Council Member Flaherty clarified that he has heard that the neighbors are willing to give the <br />dogs a chance to acclimate. <br />• Ms. Johnson confirmed that the neighbors have discussed this noting that the dogs have been <br />quieter. <br />
