NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes <br />the following findings of fact related to the conditional use permit request: <br />1. The request is consistent with the Mounds View Comprehensive Plan in that the <br />Comprehensive Plan encourages new business in Mounds View and the site is <br />designated industrial in the Comprehensive Plan. <br />2. The proposed environmental processing center would not be out of place given <br />the character and geography of the surrounding area, the location on Old Highway <br />8, other industrial uses, and the size of the subject property which is able to <br />accommodate the facility. <br />3. Given the proposed investment into the facility, it is not anticipated that proposed <br />Environmental Processing Center would depreciate the surrounding area. <br />4. The applicant has sufficiently demonstrated that a need exists for the proposed <br />business. <br />NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View City <br />Council approves the conditional use permit for the 11,200 square foot environmental <br />processing center, with conditions as follows: <br />The applicant shall consolidate parcels, if such action is required by the City <br />Attorney. Consolidation shall occur by plat. <br />2. The applicant shall apply for a Development Review prior to construction of the <br />facility. <br />3. The processing center hours of operation are limited to between 7:00 am and <br />7:00 pm, with an exception for customer emergency situations. <br />4. The applicant shall adhere at all times to Section 607 of the City Code in regards <br />to nuisances; particularly regarding Noise, Section 607.08, and Odor, Section <br />607.03. If, in the opinion of the City Council, odor at the facility becomes a <br />problem, summary abatement proceedings may be initiated. <br />5. Regular odor testing by a qualified "odor testing company" to be done on site at a <br />schedule to be determined by the city. <br />6. An Odor Mitigation analysis will be required from a qualified company who <br />specializes in "odor", prior to construction. <br />7. Exterior storage of any product or materials associated with this business is <br />prohibited. <br />8. Vehicles associated with this business shall be prohibited from parking or idling <br />on Old Highway 8. <br />9. The applicant shall submit an on -site spill response and containment plan as part <br />of the Development Review. <br />10. The Conditional Use Permit shall be reviewed one year after certificate of <br />occupancy has been granted. <br />
