Item No. 7B <br />Meeting Date: April 10, 2006 <br />Type of Business: Council Business <br />City Administrator Review <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jim Ericson, Community Development Director <br />Item Title/Subject: First Reading and Introduction of Ordinance 771 Amending <br />Chapters 502 and 503 of the City Code Relating to Liquor <br />Licenses <br />Discussion: <br />Based on direction provided at the December 6, 2005 and April 3, 2006 Council <br />worksessions, staff has prepared an ordinance that amends the liquor licensing provisions <br />of the City Code in Chapters 502 and 503. The amendments change the code to require <br />that a public hearing be conducted for every new, transferred or renewed license. This <br />change is recommended based on feedback from residents who would have wanted to <br />provide input during license renewals however were not notified of the public hearing. The <br />Council agreed and indicated that the Code should be amended accordingly. <br />Also based on direction provided at the same worksessions, the other change <br />contemplated by Ordinance 771 would be to allow our liquor license facilities to offer <br />outdoor seating in association with their establishment. The Code would need to be <br />amended to allow for the outdoor sale and consumption of alcohol in those establishments. <br />The new language states the following: <br />Outdoor Consumption Endorsement. A special endorsement may be issued by <br />the City to the holder of a regular on -sale liquor or on -sale wine license to allow <br />sales and consumption of liquor or wine outdoors when the outside service area <br />is immediately adjacent to and contiguous with the licensed premises. The <br />licensee shall make application for the special endorsement to the City and <br />provide site plans which illustrate the proposed outdoor service area. The <br />special endorsement may be issued by the City Council to the licensee by <br />resolution after a public hearing on the special endorsement is held. The <br />designated outside service area shall not reduce the number of off-street parking <br />spaces which would be required if the licensed premises together with the <br />outside service area were to be newly constructed in conformity with the City's <br />zoning code. The City may also require improvements to the outside service <br />area prior to issuing the special endorsement, including but not limited to, safety <br />barriers or other enclosures to be placed around the perimeter of the outside <br />service area in order to protect patrons from any hazards, including vehicular <br />traffic. <br />
