In addition, violation of any of the CUP conditions <br />or the Code can result in reconsideration and revocation. Community Development Director <br />Roberts stated that issue is addressed in the Now Therefore clause. <br />Council Member Stigney stated he remains concerned about the sale of poultry and would like the <br />basis for review to be identified. Community Development Director Roberts stated he is <br />confident the Council can review the use at any time. <br />Mayor Flaherty asked staff to revise the language to identify the second entrance and require it <br />remain open. Clerk-Administrator Ericson suggested adding Condition 15 to identify and <br />maintain the second access and Condition 16 that the lane width between the parking stalls be <br />maintained to assure the vendor stalls do not infringe into that space. <br />Council Member Stigney asked if there is adequate insurance to cover any injury or accident. <br />Community Development Director Roberts stated that is not a City issue or liability, it rests with <br />the properly owner. <br />Council Member Mueller asked whether the proof of insurance is adequate. Community <br />Development Director Roberts stated that insurance is different from the coverage for liquor sales, <br />which occurs inside the building. Mr. Halverson stated that Robert's Sports Bar has insurance <br />through the State for anyone who enters the property. In addition, the auctioneer has insurance. <br />He stated the liability limit of Robert's policy is over $1 million. <br />Finance Director Beer asked if there could be recourse against the City because it issued a CUP for <br />this activity. Mayor Flaherty suggested staff ask this question of the City Attorney. <br />Council Member Mueller and Council Member Hull accepted the friendly amendments, as <br />discussed, for language clarity in Conditions 3, 6, and 10, and the addition of Conditions 15 and <br />16. <br />Council Member Mueller stated this is a creative way for a business to "stay afloat" during <br />difficult economic times and she looks forward to attending the farmer's market and auctions. She <br />encouraged Mr. Halverson to collaborate with his neighbor to the northwest to assure no issues <br />arise. <br />Council Member Hull thanked the Planning Commission for their work on this application. <br />Ayes - 4 Nays - 0 Motion carried. <br />B. Resolution 7445 Approving the 2009 Comprehensive Plan Update and <br />Authorizing Submittal to the Metropolitan Council. <br />Community Development Director Roberts presented staffs recommendation to approve the <br />Comprehensive Plan Update and submit it to the Metropolitan Council, for review, which can take <br />three months. He advised of agency responses and that those comments have been incorporated <br />
