Mounds View City Council June 22, 2009 <br />Regular Meeting Page 2 <br />Council Member Mueller asked how long it takes to prepare this report and commented on the <br />large workload to inspect and follow-up on the road and trail projects. Surface Water Technician <br />Fleischhacker estimated that it takes several weeks to prepare the report and to have it reviewed <br />by the agencies involved with inspections. <br />Mayor Flaherty opened the public hearing on the SWPPP at 7:18 p.m. Hearing no public input, <br />Mayor Flaherty closed the public hearing at 7:18 p.m. <br />The Council agreed with the request of Mayor Flaherty to consider Item B first under Council <br />business since the business owner was present. <br />7. COUNCIL BUSINESS <br />B. Continued Public Hearing: Resolution 7460, a Resolution to Consider an On <br />Sale Intoxicating Liquor License for Robert's Sports Bar and Entertainment <br />located at 2400 County Road H2. <br />Clerk-Administrator Ericson noted this item was continued from the June 8, 2009 Council <br />meeting because of a failed fire inspection. All application materials and fees have been <br />submitted, the property has received a satisfactory report from the Police Department and <br />Finance Department but there continues to be outstanding issues with the fire inspection. If not <br />approved by the City, the liquor license will lapse June 30, 2009. <br />Kevin Halvorson, Robert's Sports Bar and Entertainment, stated no electric work has occurred in <br />the building since 1973 and the State Electrical Inspector has no problem. He stated the City Fire <br />Marshal has been there five times, he feels this involves selective inspection, and he is being <br />picked on. Mr. Halvorson stated the extension cords are UL approved and his insurance <br />company has inspected the property without issue. <br />Floyd Halvorson, representing Roberts, reviewed the May 5, 2009 fire inspection addressing the <br />fire extinguisher and that machines need to plug directly into outlets, when possible, to not run <br />electric cords above the ceiling the in rear pool area, and to not use extension cords for lights in <br />the dance area. Floyd Halvorson stated he followed each item but now the Fire Marshal has <br />indicated no extension cords can be used. He stated the inspection from Saturday says extension <br />cords should not substitute for permanent wiring but the original inspection report does not use <br />those same words. <br />Mayor Flaherty stated it appears there has been a miscommunication in what needs to happen. <br />Fire Marshal Osmonson explained that she and Floyd Halvorson reviewed the items at every <br />inspection but she did not know that extension cords were running above the ceiling tiles. That <br />is why it was not clearly identified on the initial inspection. She read a section of the State Code <br />indicating extension cords should not be used in place of permanent wiring and used only with <br />portable devices. She stated she talked with Floyd Halvorson about using surge protectors that <br />are UL listed. <br />
