Mounds View City Council August 24, 2009 <br />Regular Meeting Page 6 <br />Council Member Stigney felt it was poor policy and not aesthetically pleasing to allow antennas <br />in a front yard, noting there is no height restriction. <br />ROLL CALL: Gunn/Stigney/Hull/Mueller/Flaherty. <br />Ayes - 4 Nays - 1 (Stigney) Motion carried. <br />5. Ordinance 833, Amending Chapter 1113.04 of the Zoning Code to <br />Add Car Washes as a Conditional Use in B-2 Zoning Districts. <br />Planning Associate Heller presented the code amendment .under consideration and <br />recommendation to approve second reading, adopt the ordinance, and publication by summary. <br />She explained this request came about based on the Conditional Use Permit application by Leon <br />Theis for a carwash a B-2 Zoning District. <br />Mayor Flaherty opened the public hearing at 7:45 p.m. <br />John Rysgaard, Board of Directors of the New Brighton Al Anon Society, stated they are not <br />adverse to the car wash but are concerned about potential traffic conflicts in the shared use area <br />of this site. <br />Leon Theis, 2280 West County Road I, stated he spoke with the Al Anon Society President and <br />learned that out of 100 members, only 1 person voiced objection. He assured the City there will <br />not be a problem because his business traffic would not use the Al Anon Society property. <br />Hearing no additional public input, Mayor Flaherty closed the public hearing at 7:49 p.m. <br />MOTION/SECOND: Gunn/Mueller. To Waive the Second Reading and Adopt Ordinance No. <br />833, Approval of Amendments to Chapter 1113 of the Mounds View Zoning Code to Add a Car <br />Wash as a Conditional Use in B-2 Zoning Districts, and Publication by Summary Ordinance in <br />the Sun Focus. <br />Council Member Hull asked Mr. Theis if he would work with the City and Al Anon Society <br />should a problem occur. Mr. Theis answered in the affirmative. <br />Council Member Stigney stated he found this use to be too intrusive in the B-2 Zoning District <br />and noted that the ordinance language appears to favor one business since there is only one <br />gasoline service station in the B-2 Zoning District. <br />Mayor Flaherty stated he received some resident communication not favoring this amendment <br />because they believed it was too much for this area, it was to act as a neighborhood filling <br />station, and was to not compete with larger-sized gas stations. Mayor Flaherty stated during <br />Festival in the Park many approached him in support of the car wash. He explained that his <br />concern with the car wash was the location, iced conditions during winter weather, blower noise, <br />and building height, which had all been resolved. <br />
