Second Reading and Adoption of Ordinance 809, Vacating a 17.5 foot
Surface Water Easement on Greenfield Estates Property, 7521-7661
Greenfield Avenue.
Planning Associate Heller presented the request of Tycon Companies, owners of Greenfield
Estates Apartments at 7521-7661 Greenfield Avenue and 2370 County Road I, to vacate a
surface water easement. It was noted the applicant plans to replace existing garages with new
drive-through style buildings. The proposed new garages would be farther east than the existing
garages and encroach into a 17.5-foot easement by 2.5 feet, resulting in the easement vacation
request. It is expected the Rice Creek Watershed District will grant a permit for this project and
City staff has found this easement is no longer needed. Staff recommends granting second
reading, adoption of the ordinance, and to publish by summary.
Council Member Gunn stated her support for the application to improve a less than desirable
situation.
• MOTION/SECOND: Mueller/Stigney.
