Mounds View City Council August 28, 2006 <br />Regular Meeting Page 16 <br /> <br />Councilmember Gunn noted that there are other properties in the City that have the same <br />problems. She stated she believes the charges are dropped, but not by half, and that Mr. Osuji's <br />responsibility is to recoup some of the costs from his tenant. <br />Councilmember Stigney stated that if a property is leased, it is the property owner's <br />responsibility to maintain his property. He stated that Mr. Osuji is responsible regardless of the <br />tenant and it was the City's right to correct the problem and bill the property owner. <br />Mayor Marty stated the invoice was the City's cost to clean up the garbage. He stated he <br />believes Mr. Osuji's tenant is not being honest, but the City had to incur the cost to clean up the <br />garbage and if the cost is reduced, the City will have to absorb the cost. Mayor Marty stated he <br />believes Mr. Osuji's tenant should reimburse the costs. <br />MOTION/SECOND: STIGNEY/GUNK. To waive the reading and adopt Resolution 6929, <br />affirming charges associated with abatement of violations at 5300-02 Raymond Avenue Mounds. <br />Councilmember Flaherty stated that he believes the tenant is costing Mr. Osuji money. He stated <br />that the City could have done better trying to contact him and that he would be in favor of <br />reducing the charges. <br />• Mr. Osuji stated he returned his tenant's deposit within the 21 days as required by law and that he <br />was not aware of the garbage within the time period. <br />Mayor Marty stated that the City needed to deal with the problem and Mr. Osuji should take up <br />the issue with his former tenant. <br />Ayes - 4 Nays - 1 (Flaherty) Motion carried. <br />Councilmember Thomas suggested the Council discuss the notification procedures for such <br />abatements. <br />I. Resolution 6919 Authorizing an Abatement of Junk and Debris outside of <br />2318 Knoll Drive. <br />Housing/Code Enforcement Inspector Anderson stated on May 22, 2006 Staff inspected the <br />property in response to allegations of exterior storage in violation of city code. He stated Staff <br />spoke to the property owner on May 22, 2006, explained the City ordinance and requirements, <br />and issued a notice of violation to Mr. Wies citing Section 607.03 Subdivision 3c of the City <br />Code, which required that corrective actions were completed by June 22, 2006. <br />Housing/Code Enforcement Inspector Anderson stated staff did perform follow-up inspections <br />and did not notice any change in the property. He stated that there were substantial violations in <br />2003 and 2004 at the property. He stated that approval by the Council will provide Staff 10 days <br />for the action. <br />
