Mounds View City Council August 28, 2006 <br />Regular Meeting Page 5 <br />come in to the building, but they all ask when the parking lot will be done. He stated that he <br />could not lease the building until the parking is done. <br />Mr. Perrozzi stated that he worked with Velmeir with the piece of property and they need to take <br />care of it. He also asked why he could not speak with the City's engineers who worked on the <br />project. He said he will pay for the engineers' time for the meeting. <br />Mr. Perrozzi stated he is trying to mediate this situation and will begin litigation unless he can <br />get it done. He asked if the City is powerless to do anything. He noted his concern that it is <br />taking so long. He stated last fall he went to the watershed district, he told the property owners <br />last fall what the district needed, and nothing was done. He stated that the watershed district has <br />to submit a plan, the City would approve the plan, but Velmeir is not doing anything to approve <br />it. He stated there are two months to get the parking lot done. He also explained all of the steps <br />that have to be taken in order to approve the parking lot with the watershed district. He stated he <br />has done everything he can, but Velmeir has not. <br />Mayor Marty noted that there are two pieces of private property, one owned by CVS, one owned <br />by Mr. Perrozzi. He stated the City is unable to tell either property owner what to do. He stated <br />that if he and the other property owner cannot make it work, they may have to go to court. He <br />stated he has discussed the problem with Director Ericson and Mr. Perrozzi and stated the City <br />does not have much leverage between two private property owners. <br />• Mr. Perrozzi stated that the positioning of the streetlight ruins his property and he has asked the <br />other properly owner to move the light. He stated when he has hired an attorney and stood his <br />ground, the other property owner has finally listened. He noted the other problems. <br />Mayor Marty stated that Mr. Perrozzi has exceeded his three minutes and asked Director Ericson <br />to try and set up a meeting between Velmeir and Mr. Perrozzi to try and work something out. <br />Director Ericson stated that Mr. Perrozzi's engineers have spoken to the watershed district, but <br />that the plan needs to be in place before it could be reviewed. He stated that there should be <br />resolution this week. He stated he would contact the owner of Velmeir and the engineers to set <br />up a meeting. Mayor Marty stated he would appreciate such a meeting. <br />Mr. Perrozzi stated he would pay the costs of the engineers. He stated he would like to know <br />how the grades were approved and how the project was set up. He said he wants to get the <br />parking lot done to bring in tenants. <br />Director Ericson stated he is not sure if the engineers would help the problem. Mr. Perrozzi <br />stated it would help him determine the liability of the plan. He questioned why the City would <br />approve the plan for the parking lot when it may not be viable. <br />Mayor Marty asked Director Ericson to look into the issue and report back to the City. Mr. <br />Perrozzi stated he would like an answer and will contact the engineers himself. <br />
