Mounds View City Council May 8, 2006 <br />Regular Meeting Page 9 <br /> <br />Director Ericson stated that he passed out a handout that showed the area south of Woodale 1 <br />Drive on County Road 10, where there are three property owners, and if one takes into 2 <br />consideration the setback requirement of 250 feet from residential properties and 500 feet 3 <br />spacing requirement between signs, it is possible to have three billboards south of Woodale 4 <br />Drive. He noted it depends on where they are located and the billboards’ own spacing. 5 <br /> 6 <br />Councilmember Thomas stated that the issue is that it would not be best usage of resources for 7 <br />Clear Channel and they will approach the highest traffic areas first. 8 <br /> 9 <br />Mayor Marty stated that if Clear Channel cannot get them along I-35W or Highway 10, they may 10 <br />come back to this area. 11 <br /> 12 <br />Councilmember Thomas stated this goes back to the City’s good faith effort to find appropriate 13 <br />locations for billboard. 14 <br /> 15 <br />Councilmember Stigney commented that Clear Channel may not want to put a billboard in that 16 <br />area, but other billboard companies could come in. 17 <br /> 18 <br />Director Ericson stated that is a valid point and Staff is proposing that if Clear Channel is unable 19 <br />to find locations for some of the signs, the Code would be amended to lower the number of 20 <br />allowed billboards. He stated this has been anticipated all along. He stated the door should not 21 <br />be left open for additional billboards. He stated until two years from July 2005, no additional 22 <br />billboards may be located in the City by virtue of the ordinance. 23 <br /> 24 <br />Councilmember Stigney commented that if someone gets a permit, and the ordinance is changed 25 <br />within 18 months, it would open the City up for a lawsuit. 26 <br /> 27 <br />Director Ericson stated that is correct, but there will be no permits issued for a billboard if it is 28 <br />not one that is replacing a Clear Channel billboard due to the cap and replace ordinance. He 29 <br />stated there cannot be any more than the present ten billboards in the community. He stated the 30 <br />code would be amended before any permits can be issued by the City. 31 <br /> 32 <br />Mayor Marty wondered what would happen if another billboard company applies for a permit 33 <br />after the ordinance is approved if Clear Channel does not have the permits yet and have not 34 <br />negotiated contracts for the remaining three billboards. He wondered if the permit would need to 35 <br />be granted in this case. 36 <br /> 37 <br />Director Ericson stated that this ordinance was reconsidered in March because of that fact. He 38 <br />explained that the new language, that has not been adopted yet, says that the maximum number 39 <br />of billboards at any one time is limited to ten, including any billboards that legally exist at the 40 <br />time of the ordinance.
