Mounds View City Council <br />Regular Meeting <br />June 26, 2006 <br />Page 30 <br />Councilmember Flaherty said at the present time, he is not ready to authorize the contract and <br />resolution. <br />Councilmember Stigney said it will be an awful long work session and stated these types of <br />things should not be on the Council agenda to begin with. <br />MOTION/SECOND: GUNN/FLAHERTY. To postpone approval of Resolution 6853 <br />Authorizing the Contract for Architectural Services for the Preparation of Plans and <br />Specifications for the Mounds View Community Center and discuss it further at the July 17"' <br />work session. <br />Mayor Marty stated that until this meeting, he was ready to approve the expenditures. He said he <br />would rather err. on the side of caution to postpone. <br />Ayes — 5 Nays — 0 Motion carried. <br />J. First Reading and Introduction of Ordinance 775, an Ordinance Vacating an <br />Excess Highway Easement Associated with the Hidden Hollow South <br />Residential Subdivision <br />Community Development Director Ericson explained that this request would vacate an easement <br />that was dedicated to the City in 1976. He stated the City had no problem with the easement, but <br />Ramsey County rejected the plat because of it. <br />Community Development Director Ericson explained the City Council approved the Hidden <br />Hollow South final plat on April 24, 2006. He stated the residential subdivision created six <br />single-family home sites from two deep lots on Wooddale Drive. IIe said that when the plat was <br />brought to Ramsey County for recording, the County Surveyor rejected it due to the presence of a <br />"Highway Easement" at the rear of the lots. He stated the County's policy, as he has learned, is <br />that right of way easements may not persist as easements — they shall either be dedicated as right <br />of way or vacated. He said until one of the two actions is undertaken, the plat cannot be <br />recorded. The effect is to strike the word "highway" from the plat. He said the second reading <br />and public hearing would be at the next City Council meeting. <br />Mayor Marty asked if it would vacate the highway and keep the easements and Director Ericson <br />replied it would. <br />MOTION/SECOND: TIIOMAS/STIGNEY. To waive the reading and adopt Ordinance 775, an <br />Ordinance Vacating an Excess Highway Easement associated with the Hidden Hollow South <br />Residential Subdivision. <br />Ayes — 5 Nays — 0 Motion carried. <br />
