The application includes payment for all excavation <br />performed even though not all of the excess material has been <br />hauled from the project site. For that reason, we have reduced <br />the amount of payment to you accordingly as shown on the attached <br />copy of the application for payment forwarded to the City. <br />Also, we are in receipt of a letter to the Fairfield Company by <br />Willard Davis dated June 22, 1982 relative to a claim he is making <br />for payment' of work he has completed. In his letter, he states <br />that he "will file a lien with the owner of the property" if the <br />matter is not properly resolved. In accordance with the contract <br />documents, the general contractor and the bonding company are to <br />hold the city harmless in the event of any claims or liens filed <br />against the city or the fee owner of the property. Please be <br />certain that this matter is taken care of properly so as not to <br />disrupt the completion or final payment for this project. <br />The Mounds View City Council has discussed the lack of completion <br />of this project. It is quite likely that liquidated damages will <br />be deducted from f<.nal payment in accordance with the contract <br />documents.
