*4u <br />TO: Mayor & Council <br />FRCM: Finance Director -Treasurer Erager <br />'DATE: September 30, 1982 <br />RE: CERTIFICATION OF DELINQUENT ACCOUNTS TO WE COUNTY <br />Pursuant to Council direction given at the September 27, 1982 <br />meeting a list of persons ageing money to the City other than utility bills <br />is attached. These include amounts due for tree removal originally billed <br />in the fall of 1981, developer's administrative charges and insufficient <br />funds check charges. <br />I spoke with the City Attorney and was advised that at the present <br />time the City has authority to levy a tax only for delinquent utility bills <br />and tree removal charges. In his opinion no authority exists to levy a tax <br />for other amounts due to the City. <br />Subsequent to the City Attorney's opinion,letters (registered mail - <br />return receipt requested) were sent to those individuals that have past due <br />utility and Lxee removal bills. The ietLi:rs aiivi5iti of CAWlcil's intention <br />to consider levying a tax on their property for the past due amounts unless <br />payment was received or an agreement for installment payments was entered into <br />by October 8, 1982. A copy of the letters sent is attached. October 8, 1982 <br />was chosen as the last day for payment or entering into an agreement because <br />October ll,(the next working day) is the last day for giving the County a <br />signed resolution authorizing the levying of the tax. <br />If it is Council's desire to levy a tax for delinquent utility and <br />tree removal bills, staff suggests a resolution be adopted stating any amounts <br />remaining unpaid at 4:30 p.m. October 8, 1982 be levied as a tax against each <br />affected property. <br />Enclosures: List of delinquent utility bills <br />List of delinquent tree removal. bills <br />List of delinquent administrative charges <br />List of insufficient funds check charges <br />Copy of letter on delinquent utility bills <br />Copy of letter on delinquent tree removal bills <br />Proposed resolution levying a tax for delinquent utility <br />and tree removal bills <br />
