K g <br />MEMO TO: Clerk -Administrator and City CUnIICil <br />FROM: Director of Public Works/Community Development <br />DATE: May 10, 1983 <br />SUBJECT: POPPELAARS DEVELOPMENT <br />Attached please find the following items regarding Tony Poppelaars <br />proposal: <br />1) Planning Commission Resolution No. 75-83 <br />2) Planning Commission Minutes of May 4, 1983 <br />3) Chapter 48 and 49 Reviews <br />I believe all Council members are quite familiar with Mr. Poppelaars' <br />proposal. Some of the key issues of this proposal include: <br />1) The Planning Commission reviewed and granted a variance to <br />allow development within the 100 foot buffer area and from <br />20 to 10 feet for side yard setbacks. <br />2) That the two lots be combined into one lot in order for <br />the applicant to request wetland credits as identified in <br />Chapter 48. <br />I 3) Chapter 48.06, Subdivision 4(A)(1) allows modifications of <br />dimensional requirements for the purposes of protecting <br />wetlands. A 10 foot side yard setback reduction being <br />proposed falls under this dimensional modification. <br />4) The property must be redesignated from R-3, Medium Density <br />Residential to R-4, High Density Residential since the <br />zoning map has never been revised per the last Code revisions. <br />5) A conditional. use permit be granted to allow filling a por- <br />tion of flood plain per the requirements of Ordinance No. 49. <br />6) An easement be conveyed over the wetland area for drainage <br />purposes. <br />7) Performance and maintenance of the weir and control struc- <br />ture to be the owner's responsibility. <br />Please review Chapters 48 and 49 review which is attached at the back <br />of this packet of information for a review of wetland and flood plain <br />issues as they relate to this proposed development. <br />A site plan of the proposal will be available at your meeting on <br />Monday. <br />/bc <br />Attachments <br />
