-7- <br />(3) PenalL . Any person, firm or corporation which shall <br />violate any of the provisions nf this ordinance shall upon <br />conviction thereof be subject to a forfeiture of not less <br />than twenty-five dollars (325) nor more than two hundred <br />dollars ($200) and each day said violation continues to <br />exist shall be considered a separate violation." <br />2. Chapter 37 entitled "Erosion rnd Stormwater Runoff Control" of the <br />Madison General Ordinances is created to read as follows: <br />"37.01 TITLE. <br />'Phis ordinance shall be known, cited and referred to as the Erosion <br />and Stormwater Runoff Control Ordinance. <br />37.02 FINDING AND DECLARATION OF PURPOSE. <br />Tne City tins that urpanizing land uses have accelerated the <br />process of soil erosion, runoff and sediment deposition in the <br />waters of the City of ht3dison. Therefore, it is declared to be the <br />purpose of this ordinance to control and prevent soil erosion and <br />minimize stormwater runoff increases and thereby to preserve the <br />natural resources, control floods and prevent impairment of dams <br />and reservoirs, protect the quality of public waters, protect <br />wildlife, protect the tax base, and protect and promote the health, <br />safety and general welfare of the people of the City of Madison. <br />37.03 GENERAL PROVISIONS. <br />1 r. ica i ity. This ordinance applies to the use of lands <br />within the incorporated boundaries of the City, and the use <br />of lands subject to extraterritorial review as provided by <br />Wisconsin Statutes Chapter 236.10. <br />(2) Severability of Ordinance Provisions. If any section, <br />provision or portion of t us or inance is adjudged <br />unconstitutional or invalid by a court, the remainder of <br />this ordinance shall not be affected thereby. <br />(3) Performance Time Reouirement. All action required in this <br />ordinances all a coriau to as soon as possible as <br />IiPtarm;..d hA.—t., '.,a AuthoritytWu.,1eat.,I.." ,. <br />37.04 DEFINITIONS. <br />or t e purpose of this ordinance certain words used herein are <br />defined as follows: <br />Administrative Authority means the governmental employee <br />destgnate y t e ommonouncil to administer this ordinance, and <br />includes any other governmental employees who are supervised by the <br />said administrator, for the implementation and enforcement of this <br />ordinance. <br />Agricultural land Uses means alterations or disturbances of the <br />land usea for t e production of food and fiber. <br />C <br />
