Accessory buildings geanter than 216 -square feet require a conditional <br />use permit (40.04, :;ubdi.vision 1)(4)). <br />2. As stated .in Chapter 40.23, Subdivision A(5), the Planning Commission <br />shall consider possible adverse effects of the conditional use permit, <br />those being; <br />a) Relationship to municipal Comprchcnisvu plan. <br />b) The geographical area .involved. <br />c) Whether such use will tend to or actually depreciate the area <br />in which it is proposed. <br />d) The character of the surrounding area. <br />e) The demonstrated need for such use. <br />3. The applicant has stated they need the oversize accessory building <br />because of vandalism occurrences in the neighborhood (see attached <br />sheet). <br />4. It is Attorney Meyers' upini'on that iho need to protect• personal <br />property is a justification by which a conditional use permit for <br />this size of accessory building could be granted. <br />5. The Planning Commission Inay choose to recommend that a condition of <br />the conditional use permit would be that the accessory building use <br />be restricted to the current• applicant and that the building should <br />be removed should the property be sold thereby eliminating a non- <br />conforming building from being transfered to a subsequent property <br />owner. <br />
